How about both Aurich and Game on Graffix take this dispute up with Condé Nast? Especially after the whole Predator take down.
Again, boycott if you want, but no one in this disagreement has licensed these assets from the licensor. Both ends are bootleg in one way or another. Don't jump to conclusions here thinking that GoG is shady. Game on Graffix has been fantastic for me on the arcade end (CPOs, etc.) of the hobby.

Aurich's art belongs to him, just as much as the movie art belongs to the film studio.
The Shadow radio show from the 1930's is probably public domain. The Shadow from DC's comic book & its likeness is owned by Condé Nast. That wasn't very hard to find via quick internet search.
I don't see The Shadow listed in this article.

Exactly. An email would have been the proper why to handle this, but ultimately this falls in line with Pinside behaviour. They love a witch hunt around here.

The thing we actually learned here is that when sending your work off to someone, send a disclaimer that it is not for redistribution by any means & to always be sure to read the fine print / check boxes.
