I don't know about "clearly visible." Easily to spot after you see the OP's image of the damage. Sure. But going off of that photo, you can't fully see the damage, and would be easily overlooked. Now if the seller posted a closeup of up it with something like, "Here's a closeup of the scuffs." Then yes, you'd be able to say that it was clearly visible, and you'd have something to base the language used, with the condition of the machine.

Looks like NOS to me. But hard to tell from photo. That's how things come out when they come from professional printers. Probably some crop marks in the corners too? Can't tell from the photo. But I'm guessing someone didn't just print it in their house.
