Just read the first few pages of A-2 to help me better understand the amazing clips BBJ made for us. It looks like those are from a Scott Allen who with another person helped bring in assets to the funds side of things. “32 million” was in there a few times so my understanding is that is the value of the insurance policies they had in their possession early on. Either way, the fund side of things is more this guy’s area of understanding. Reading about his perception of seeing the pinball side of things, even he saw that pinball has a pretty extended development time up front and it takes a while to get to a point where you have something to sell.

One thing with the pinball side of things... is there anything indicating the SEC is aware of or documenting all of the money that Robert threw at TPF sponsoring things? Travel to pinball events? Etc. There were years of non-R&D spend that occurred prior to anything resembling a 'reveal' of sorts.

I have a hard time believing that would be considered an operating expense when you had literally nothing to market. No product to tie it to. It just seems like a vanity spend.

I'm hoping that since he hasn't been charged criminally and arrested yet, some new law emerges which makes life more difficult for him. In fed system, it's the date your arrested which starts the clock and determines the law your under. Federal sentencing laws and terms of supervised release can change and become effective on Oct 1 of each year. Be great if he screwed himself in the long run by slow playing everything.

Excerpts from Exhibit A-3.

This is another funds guy, and it covers a lot of similar ground to A-2. There are dozens of pages of tortured attempts by the defense to pretzel the deposed to say that the finances were handled properly, and the SEC attorney objects to pretty much every question. So you'll have to read the original doc if you're into that stuff because it doesn't lend itself to snippet-ing.

I'll note this is the first of multiple exhibits that mentions church-connected relationships with hiring and investments (like the car wash). This is stuff I opted not to report last year because I didn't want people to use it to attack Robert's religion, since some have previously ridiculed him on that front

And I still don't want people to do that. I think it would be unfair. People of all kinds of faiths (and no faiths at all) can do scummy things.

When Robert approached Spooky back in 2015 his sales predictions for RAZA, MG, other non-licensed theme etc were insane. I really wish I'd have kept his deck. It was a major red flag, one of many. He actually thought stuff like RAZA would sell like 4k units.

I think, in his mind, the games would sell really well so all the money would "end up back in the cookie jar" and it wouldn't be a problem that it ever left. Like when Paulie spent all Rockey's money while he was in Russia.

We also have to take into account that Robert is crazy.

I really liked and respected him, and I already miss his contributions. He was smart, helpful and funny.

He was primarily even keeled on Pinside, unlike myself, and someone I could learn from.

Nobody will give a shit in 5 minutes, but I consider him a Pinside loss.

One surprising thing in what they're saying is that investors were not even actually investing in the claimed investment of insurance policies, but rather just giving money another one of Mueller's companies named "Life Insurance Policies". Yet again, fooling investors in regards to what they're actually getting. Yikes.

I'm not sure why I'm shocked that Mueller lied in court but here I am. This is just proof (as if any more was needed) that this guy is a first-grade a-hole dirt merchant that feels zero remorse for his actions. First class narcissism on full display. Mueller's defense seems to hinge completely on the idea he was allowed to take compensation... yet doesn't counter any of the SEC's points about how being entitled to compensation doesn't sanitize the type of transfers he made, nor his conflicting language between what was told to others vs his actions.

The great news is that by insisting Mueller alone hold all the keys to the vault, and the only one allowed to make spending decisions -- he pretty much guarantees all liability for those choices are his own.

Mueller's defense basically boils down:

1. If it wasn't for that meddling SEC, I would've made millions selling RAZA and would be able to put money back in the piggy bank before anyone knew it was gone!
2. Also, all that evidence that makes me look bad should not be admitted.

SEC's counter is:
1. Hey buddy, there has been no mention of pinball in any of this - your business structure has been fraud from the get go!

Anyway, not a lawyer - but there are several avenues here:

1. Summary judgment in full
2. Summary judgment in part, jury trial for rest
3. Summary judgment denied, jury trial

My guess is probably #2 will happen

We have no idea when the ruling on the summary judgment will happen, but according to filing #102:

1. Various pre-trial motions due October 26, 2023
2. Join pre-trial motions Nov 3, 2023
3. Final conference Nov 16, 2023
4. Jury trial Dec 4, 2023

Maybe we'll be able to dial into the trial? Otherwise people can go in person!
