Quoted from TreyBo69:

Pretty gross they get to keep profits off of assets bought with stolen goods. Don’t they owe a fuckton?
Whatever they have left is just being hidden…
Can’t imagine how frustrating it is for the victims.

Quoted from Mr68:

What is it about innocent until proven guilty that you guys don't understand?

What I don't understand is why it gets misstated all the time. The most important word of the entire concept gets excluded more often than not:

One should never say "He is innocent until proven guilty." If he "is innocent" then he didn't do anything to get proven guilty of!

The correct terminology would be "He is PRESUMED innocent until proven guilty." The presumption of innocence is the whole point of the concept. It is why our legal system puts the burden of proof on the prosecution, instead of making the accused prove their innocence.

But that's about court. No one can tell me there is any chance in hell that he, however temporarily, "is innocent" of making 60 million dollars of other people's money disappear!

I presume that clears things up for everyone?

With another sale hearing approved and scheduled, another pennies on the dollar $1m will likely soon be making its way to the trustee. Interested prospective bidders or parties with objections to this plan should getting to work getting the opportunity to attend.

Makes total sense to me.

I do not get how people can continue to operate completely unethically and not pay for it in this industry.

Quoted from Mr68:

I'll bet they gave Robert a fancy title. Something like, Vanishing Assets Manager

Robert could easily just be in an entry-level or mid-level support role. Just because he works for a recognisable organisation like Boeing, doesn't mean he secured a position with substantial responsibility.

#32057 1 year ago

Maybe, but that's wishful thinking.

No argument, I totally agree with you on that.

Now, please carefully analyze the fictitious title I suggested, ""Vanishing Assets Manager""

It's a joke regarding Roberts recent history and the key breadcrumb is the first word, "Vanishing".

Sorry you missed it but good to know I'm not alone in making an easy mistake on Pinside. - Right? DanQverymuch ?

What if he showed them some of the pinball parts he designed and now hes helping design airplane engines! He brought octo-manufacturing to Boeing.

He sold them on his "Jumbo Jet at Cessna prices" idea...

Seems like self promoting big talkers manage to find their way into higher positions. I expect Robert will go far...

Quoted from mbeardsley:

...assembled lean and agilely by a handful of dudes around a workbench.

He won them over with "a 737 max for every family and a family for every 737 max!"

Pure genius, Robert.

What do you know, we actually have two interesting updates. One bankruptcy and one SEC.

Bankruptcy: Creditor files objection to proposed Hawaii real estate settlement. Some good details and arguments in the objection.

deeprootcapital-169-2022.10.11.pdfdeeprootcapital-169-2022.10.11.pdf
#32067 1 year ago

SEC update: Robert had been granted use of $20k from the Hawaii trust to pay for expenses through July 15, 2022 related to his criminal defense. Apparently, those funds were not used within that time period. However, Robert has incurred additional criminal defense expenses. The attorney files an unopposed by the SEC motion to allow him to use that money earmarked for pre July 15 expenses to pay post July 15 expenses.

66-main.pdf66-main.pdf

Don't know if this means things have more recently picked back up on the mysterious criminal defense front or that they never stopped and for whatever reason they didn't apply the funds they could have during the time they originally could have per the court's prior order.

"Its apparent it should be a non-starter". Is she talking about the proposed settlement, or the whole attempt at starting a pinball company?

Referencing the proposed settlement, which does seem to be BS if the statements in the objection are accurate.

Though in slow motion, the other deeproot pinball assets sell-off shoe has finally dropped.

Trustee motion to sell off the remaining deeproot pinball property (physical, software, IP) has been submitted to the judge for review. It also includes proposal for dealing with office stuff in Utah.

Stalking Horse #2: Turner Logic offering $50k for the Pinball Property. Opponent bidders would need to offer at least $60k.

Trustee, as current owner of deeproot IP, also wants to grant Turner a pinball software license in consideration for the horse.

Attaching screenshot excerpts from a single skim, along with full file.

So if someone was going to bid $60k, surely Turner would beat that...

#32072 1 year ago

Can't get the "yuck" out of my brain on all this insider subcontractor stalking vulture bidding stuff.

Paid to be a subcontractor and gain an intimate awareness of asset value, remained insulated from fallout of company collapse, and now picking over the value of what remains with a clear bidder's advantage?

Or American pinball since they are already flirting with trying to promote magic girls with coin taker. Why go through all that flirting for just the handful of cabinets the guys in germany want to sell?

Having sold the disputed IP again will further complicate any resolution of the dispute over magic girl

You never know lots of whale investors out there with lots of cash. If the deal goes tits up, write if off as a business loss.

I thought it was still in doubt which IP deeproot actually owned? I thought Bill Brandes owned stuff like RAZA

So how can they sell IP which isn't theirs to sell?

Easy sell it, & the new owner sorts through the fine details.

To distract from what people were expecting to see from them at Expo. No new game from them in well over two years (LOV not really an AP game) nor did we have hear anything from them about their homebrew contest beyond their announcement at last years expo. Seems they just completely dropped that. Clearly the MG distraction worked, as neither of these things has gotten much chatter.

Certainly possible they want the IP, as they did bring in Nordman and Bowden from deeproot, that should give them some insight as to what might be of value. The bigger question is who actually owns the IP for Magic Girl.

#32084 1 year ago

The bigger question is why would AP pursue Magic Girl at all?

They need a hit. Why they keep effing around with odd unlicensed properties is a profound mystery.

yea.. i mean didnt they get burned enough the first time when john used them to get half working magic girls out to customers to avoid litigation? learn from your mistakes.

Talking about Deeproot Pinball, not the coach. But who knows time will tell. I am sure Chris Turner has a game plan in place, even if someone else comes in for the win or loss.

Deeproot Pinball fiasco is a mega beast. Likely a few whales or pinball companies looking into it.

#32092 1 year ago

So the location of the 2 prototypes is suspected or Turner has knowledge they are there for sure?

Why is the UL lab named but not the Washinton Contractor?

The Zidware IP definitely caught my eye as well. Brandes contends jpop's attempted transfer of those rights to deeproot was always invalid as Brandes owned the IP. Back when Robert was still saying he was trying to build Raza, Bill said he wouldn't create any impediment to those efforts. Does that stance remain now with zidware stuff available to the highest bidder?

Fix spoke at length on podcasts about how he was trying to get deeproot games IP (for whatever reason - actually, I think the reason is described above by another poster: years of talking up all the original games AP would be putting out with nothing to show for it - only got out LoV because someone already designed and made it - try the same thing again with RAZA? Food Truck? I was not surprised by the Expo no-show).

Anyway, Fix expressed challenges with communications related to the deeproot ip acquisition. If he and American want the stuff, they've now got a straightforward way of going after it.

PS, the court has already responded with notice of an expedited hearing to consider the motions for Nov 1. As you'll recall, the first stalking horse hearings were quite interesting.

The court now longer defaults to providing webex conferencing links publicly for these hearings. So we should reach out to Deanna Castleberry for the hookup.

Say what we all want to about JPOP and his ability to finish anything, but what that European group along with apple juice did to make Magic Girl work is nothing short of phenomenal. Seriously it is such a beautiful pin I’d buy one (not pre-order, never pre-order again for anything) if it became available. He truly has a winner there. Too bad the artistic flare couldn’t have been pared with actual engineering skill before it came to this.
