There are errors in that list of creditors. There are addresses that are apartment complexes with no apt# listed. Sounds like a way to claim you sent notices about bankruptcy, but not really sending them anywhere meaningful.

That Afghanistan address is probably because it’s the top country in the drop down list..

The deadline clock ticked down for the third time on Robert's required response filing. You'll never guess what happened this time! (He filed another extension request)

One item of note from this request:

Screen Shot 2021-12-17 at 6.58.37 AM (resized).pngScreen Shot 2021-12-17 at 6.58.37 AM (resized).png

That filing comes from Robert's lawyer, but the agreement to file a motion to extend was mutually agreed. What might the working together to resolve look like?

Like, I can see how one could "make this go away" with restitution, but we know he's got nothing and was asking for a monthly stipend. So is this trying to dance around and stretch out the inevitable?

Does anyone think Mueller will see the inside of a jail cell over this?

#27455 2 years ago

Who knows. Maybe it’s a ploy by the SEC to get him to admit wrong doing and then poof criminal lawsuit?

But - it is white collar crime so maybe he’ll get off with a curt apology from the SEC!

Quoted from SantaEatsCheese:

I doubt it, and I bet he'll still walk away living in a nicer house than many of us could dream of owning and living a somewhat comfortable life. Its too bad because he deserves some pretty severe punishment but it just seems like these sort of crimes usually end up with a somewhat major slap on the wrist and then they go back to living a decent life with money they squirreled away. I hope I'm wrong.

Whoa!
That's huge. I don't recall any previous "official" mention of a criminal case. As far as I remember it was all an SEC civil case.
My guess (hope) is that RM is working out a criminal plea agreement that would cover the civil issues as well.
That would (hopefully) include jail time.

Also possible that the Gubmint is ready to file criminal charges, and everyone is agreeing that the criminal case needs to play out before the civil issues are resolved. Either way it makes criminal action seem likely.

Criminal case has actually been mentioned several times by Robert's lawyers. Funny enough, I screenshoted that excerpt to highlight the part about resolving the civil issue without noticing the mention of the criminal

Yes. I think that RM really has squirreled away a significant amount of money. That fits exactly in under the cover of the terrible bookkeeping he did. He knew this end was coming a long while back and planned accordingly.

Well certainly don't want to get someone in trouble. Maybe just a watch party chat haha.

IF he did that and WHEN it’s proven, punish him.

Until then treat everyone fairly. Even suspected scumbags.

Will that hearing likely be entertaining? Unlike certain pinball geniuses, I don't have bankruptcy experience.

Hard to imagine it will be anything close to as entertaining as the Kuleks. Man, that was some top comedy.

It's a trial and a bankruptcy. It's a public affair regardless of verdict.

Quoted from clempo:

Are these 74 paying customers or it also includes Zidware claimants that were promised a machine?

Don't forget...30 of those RAZA's were for Robert which brings it down to 43 paying customers.

#27472 2 years ago
Quoted from PismoArcade:

Don't forget...30 of those RAZA's were for Robert which brings it down to 43 paying customers.

So does that make him a creditor?

On a more serious note, I've read this claim but not seen its origin - got a link?

#27473 2 years ago
Quoted from PismoArcade:

I thought someone found 74 names on the list. Plus those 30 for Robert, that would make 104 RAZAs if your claim is right.

Quoted from NoQuarters:

Beer store on the list but no Escort services ?

Escorts don't provide services on credit.
They are also too smart to pre-pay for pinball machines.

#27476 2 years ago

Some people bought multiple Pins. Some were refunded, Robert said 3 but it could be more so add the 30 he reserved for himself and that is 110-120 like he claimed when ordering stopped.

How about the mail order bride place ? Are they listed on the bankruptcy creditors ?

We're really splitting hairs here. This thing bombed. Literal years of promotion, marquee sponsor status on big events, the "Deeproot Theater", flying vips in. For this many sales?

I'd be curious what Robert was expecting to sell. He talked a game of it being no big deal, but there's no way he didn't want to turn on the money taps. And now we see how much he needed that to happen.

The number was not many - I would guess a decent portion of those are zid/vaporware people too - not a whole lot that signed up during the preorder window. This was a flopperoo from the start even discounting all the smoke, mirrors, thievery and other baggage. Still surprises me people risked money with all the red flags, and at that for a woefully mediocre game and cast of very questionable principals.

To top it off, if memory of the saga is correct, Robert knew the SEC was on to him before the order window started. At least I think that is what we learned, though this saga is so long I have a hard time keeping track of how and when and where the events occurred and the order of deceit, to put it kindly, fits in the timeframe. When and if he is charged I would use the word criminality in place of deceit. My opinion is it is probably only a matter of time concerning being charged criminally. I would not be surprised if the scope of things is even wider than what is known so far.

Someone suggested here he had to open orders to be able to say it was a legitimate business with some expectations to make money.

#27482 2 years ago
Quoted from Mr68:

Any guesses as to how many RAZA games are on order? (edit)
My guess is around 100 games and that's for both the Standard and the Xtra combined.

Posted January 26th, shortly after the pre-order window closed and long before meltdown. I was speculating of course but I'm kinda proud of that prediction in looking back.

Speaking of the meltdown. Do you guys remember, before the SEC announcement, when Robert was scrubbing the internet of his Facebook accounts, LinkedIn and all of his social media? He maintained contact with some of the pre-order people during that time and assured them that the games were still in progress and he would deliver.

I'm trying to imagine what creative verbiage Robert could possibly have used to sell that load of crap.

If you can sell a bunch of people into giving you their life’s savings then selling a boutique pinball machine to deep pockets is child’s play…

From his 2015 prospectus, he was hoping like 5k Magic Girls and I wanna say 2k ish for RAZA and AIW each.

I tossed that pitch deck (kept the notebook and pen though) so that's from memory. But yeah. Eye-watertingly high goals, pulled from his ass not even having played the games (pre-Pintasia) He only cares about art.

One of the many reasons Spooky told him to pound sand. Told Charlie "he will never sell this many full tilt Jpop games and we will get blamed when it fails"

Wait, did RM say Spooky would get blamed when DR fails? That is not an angle I had considered. Maybe this IS all Spooky's fault after all... 10D chess... maybe Stern is next on Charlie's hit list?

Oh I guess I worded that strangely. No Robert didn't threaten blame. The sales goals were a red flag. Sell company, don't reach the unobtainable goals, lose your job.

Kind of like EA closing studios when a game doesn't sell.

I wonder how long the founders of Spooky would have hung around the Titanic for. Even for a paycheck, I'm guessing it would have been untenable.

Thankfully we all said no, but the docs reveal Robert's first attempt at funding in spring 2015 failed. So maybe it never would have happened in the first place.

Addendum: The real deal breaker wasn't Robert. It was having to work with John since we'd basically be tasked with finishing ZW games (this was pre Pintasia) That was the line in sand nobody wanted to cross.

Reminder: The first day of deeproot's octo-bankruptfacturing hearing kicks off Monday, December 20th, at 11 am central. I posted Instructions for joining live by webex or phone a little ways back.

Unfortunately, my holiday break doesn't start until Wednesday. And that means I tragically not be able to dedicate proper attention to this masterpiece when it is finally revealed.

So I'm calling on all the junior rooters out there to citizen journalist document this catastrophe within an inch of its life.

I don't care if you do it for Bobby Big Balls.

I don't care if you do it for Jpizzle or PopDaddy or whatever cringe nickname Robert said they called him (anyone remember what it was?).

I don't care if you do it with hopes of getting iceman six bottle caps for his dr store credit.

I don't care why you do it.

I just care that you do it.

Do it.

There are 55 stainless and 76 Dormant Blue Glass Frames and PinBars. It appears the release was for 131 games.

Insider info. I am going to guess that there are less populated playfields than that running around.

While speaking of harvesting RAZA parts, I hope someone steals the dirt bike jump ramp mech. It was a clever little non-energized toy. Shoot up the jump ramp to try and hit a standup, then the ball falls back and goes through the lift ramp. That was about the only good original idea on that whole playfield...

I'll try to listen to the court case later. Let's see how Robert tries to twist his way out, if he even shows. Part of the fun of the Kulek case was the judge being super annoyed with him for blowing it off till a warrant was issued and his ass got hauled in front of the judge.

Isn’t this hearing only about combining the ~7 bankruptcy cases together?

It’ll probably be two minutes long.

Oh no. I hope not. Like I wrote, I don't know anything about bankruptcy court.

Two minutes would be appropriately disappointing.

Even so, would still love to see a crappy webcam feed of RM joining his 11 bankruptcy cases together. Perhaps he will be seated at a desk from Harbor Freight? Seated inside a PinPod booth for audio quality reasons?
