I have not followed this thread at all but just listened to two of the court proceedings. It was so clear that Kevin Kulek was lying to the judge when answering most every question the judge and the plaintiff's lawyer asked him. Certainly the judge must have seen through it all. And he can't afford the bank fees to print out his prior statements? Ridiculous.

If Kevin doesn't do some time for this obvious fraud, I would be surprised.

Quoted from vdojaq:

Love and good intentions do no pay the bills to raise a large family.

Yep. The Kuleks had 5 kids for selfish reasons.
My wife and I waited until we had secure jobs and bought a house in a decent neighborhood before we chose to have kids.

Not to say poor people are stupid, but Stupid people tend to be poor and have more children because they don't think things through when it comes to the big picture.

Quoted from pinsanity:

I was referring to the distressed property figure of 28k.
28k will get you a tin shed with windows on the outskirts of Bourke.

I could sell my modest house in Southern California and buy more than 20 Kulek houses. Then maybe rent them out to the various Kulek relatives who must rent because they haven't had the opportunity to steal other people's money to buy their own house.

Does anybody else find it surprising that the judge agreed with Ma Kulek's explanation of why she thanked her son for the trailer over Keith's assertion that it was evidence Kevin bought the trailer for her?

#16198 6 years ago
Quoted from flynnibus:

No - it only means the leap suggested by Keith was not strong enough on its own to be indisputable. The huge delta in assumed value also undermines the claim. The judge just basically said 'there is enough here worthy to be argued'

I get that. But if you go back and listen to it again, the judge specifically says he's inclined to believe her story over Keith's.

Quoted from vdojaq:

Here , I don't want to hijack the thread, but here is a prime example of how society no longer takes responsibility for their actions. I belong to a local Facebook group for my community. One of the members posted a picture(below) and captioned it with "What a jerk, I had to move my car up so I could load my stuff in the back!" She is the driver of the white Scion XB. She backed into the parking spot and left enough room so she could load. When she got back, she saw that the owner of the Expedition had parked 2 feet over the line and her efforts to make it easy to load and leave were now fruitless.
You would not believe the people who blamed her and called it her own fault because she backed into the spot. Really? About half said it was illegal to park that way, some said it was rude to park that way, some just said it's stupid to park that way and she caused her own problems. The other half said yeah, Expedition driver was careless and rude. I still shake my head in disbelief! What I don't understand is how people think they are smart to defend and point fingers the other way when something is so blatantly and factually wrong? I really believe it's the art of distraction and this what society has become. It's everyone else's fault, don't blame ME or facts for what I did!
Kathy Kulek believes she can take the heat off of herself by creating alternate facts about everyone else involved. See, they are the real bad people, not me, not my grandson. What we did is nothing compared to THESE people who a ruining our lives because they are trying to hold us responsible!

Seriously. The guy accidentally parked over the line probably because he used the other vehicle as a guide. It has nothing to do with taking responsibility, and certainly not a prime example. Mountain out of a mole Hill.
And yes, you did hijack the thread.

Quoted from Jvspin:

Good point. It does seem weird that the judge who was assigned to hear the bankruptcy case would also be assigned to hear the defamation case at the same time.
For the lawyers out there, is this usual?

I understood it as this judge only rules whether the defamation suit can go forward or is dismissed.

Quoted from Lonzo:

Interesting that Hilton projects himself as this ambassador for pinball but he forgets that he has been a cheerleader for failed/failing companies and he sure doesn't feel bad that he worked a backdoor deal out to get an Alien before people that have paid money and waited years for a machine.

Oh snap. Question for Hilton. If Heighway goes under without shipping games or refunds to its customers, will you give up your Alien to be auctioned off so the proceeds can be distributed evenly to everyone who is owed money?

#17264 6 years ago
Quoted from Whysnow:

I did not work out any sort of back door deal to get an Aliens.
I put down my name and paid the deposit to hold my spot, just like anyone else in Heighway 1.0 Not sure where you get your BS lies from but you are wrong.

Please see above. Aliens was bought and paid for with a company still in business and selling a legally made machine. I know you like to try and pile on when given the chance, but you should pick your options of when to jump in a little better...
I would NEVER make any sort of deal to personally benefit from something like getting a Predator machine/parts after the company failed and we all knew the truth of the shitstorm a comin'
Reality is that Kevin called me when it was all going down and told me to come on over and get the most recent prototype game he had build and to take it as my own. He "felt bad" that I had been such a proponent of him and wanted me to get something. I turned him down and told him to pound sand.
You are trying to make the comparison, but you just look silly since they are not even remotely similar and by the sounds of it Heighway is righting the ship and has refunded all but 2 or 3 people (not sure, but from what I have read that seems to be the case)

As far as the Predator situation, I'm totally on your side. As far as piling on, you must have me confused with someone else. When have I ever piled on you? In 5 years on pinside, have I commented more than 1 or 2 negative posts towards you?

I don't follow the Alien thread, but the last I heard was that refunds had stopped and many people were still waiting for their money back or their game. The key word I said was "IF". If Heighway went under and there were some people(or even 1 person) who got shafted, would you auction your game and evenly distribute proceeds? Because IF that scenario plays out than it would be similar to the Kulek predator mess. Andrew did plenty of lying and deception regarding the license and a whole bunch of other stuff just like Kevin. You certainly got preferential treatment over other Alien preorders. You can't deny that.

Quoted from cfh:

At the time I knew little to nothing about the whole predator thing. It's been a number of years so it's hard to remember exactly when I knew about tim, but the day I went over there in general I didn't know anything about the whole fiasco and never heard the name tim fife. It was just a rare game that somebody suggest I should go look at while it was viewable. when I saw the machine It looked amazing. The software seemed a little lacking but other than that it looks like a production game. It was very attractive. After seeing it and doing a google, I understood more. I think if Kevin had been able to make them, it would've been a hit. He just had to upgrade the software but cosmetically it was pretty cool.
I'm not really sure why it really matters. Somebody called me and I got to go see a rare machine. I didn't realize that it was some kind a weird thing that everybody would be upset about. I got to look at it and examine it and play it without the confusion of it being at a show. I hardly think there was anything wrong with doing that. For me it was a unique opportunity to see something I've never seen before. One was at the Michigan pinball Expo and I unfortunately didn't go that year. So My knowledge of the game till this point was about nil.
This will end my postings about this machine. I've contributed all the information I have to offer. And it seems people just get upset when I do that. So I guess there's not much point in me adding anything

I don't have any skin in the game, but I'm guessing those that do would appreciate a statement from you that goes something like this-

"I do not currently own, nor have I ever purchased or taken possession of a Predator pinball machine or Predator specific parts."

That would go a long way toward calming the conspiracy theorists.

They were never happy.. they're just living with some extra laptops, a waterlogged trailer, and i'm guessing 4-wheelers with engines full of water

And six figure cash reserve buried in the yard. I bet it makes them pretty happy.

Quoted from DanQverymuch:

You mean Fry, with the text "Not sure if trolling, or just stupid"? Do I really need to explain a pun? (Parsley is a garnish/sounds like partially)
And I meant to misuse the word garnish, having previously explained the difference from garner myself. Do try to keep up.
That meme would seem to apply to your response, not mine.

Ex Squeeze me? Baking powder?

If I was married to that woman and Kevin was my son, I might take off with a truck driver as well. That woman could turn any man gay.

Sorry, but a whole city is fucked. Not really funny.

If an earthquake hit every 3 years or so and severely damaged my home each time I would move out of SoCal, or at least rent. It makes me think of Sam Kinnison’s advice on world hunger. Rent a u-haul.

You live in the desert! Nothing grows out here! Nothings ever gonna grow here! Move!

Quoted from TheLaw:

In all honesty, she had a lot less of a negative affect on the whole issues then Whysnow & Lawyer Keith.

I wonder how many Lamborghini payments Keith was able to make with the money he earned working on this case?

#18358 3 years ago
Quoted from frolic:

Not sure if this was posted in this thread before, just found it online, dated 2019:
https://www.leagle.com/decision/infdco20190111h16

So from what I read from that is Keith basically made unsubstantiated claims against Fife about the transfer of two games from Kulek to Fife. Keith told the court his claims were based on sworn testimony. When the court asked Keith to present evidence of this fraudulent transfer, Keith handed the court a 47 page printout of this thread.

And that’s how you make the big bucks that allows you to drive a Lamborghini. Well that and possibly snooping through other people’s papers when they’re not looking.
You can’t make this stuff up.

Quoted from investingdad:

I've never understood the phenomenon of men with either no real ability to support themselves, or questionable ability at best to be a family provider, always seeming to easily find any number of women that are apparently blind to this.

Stupid people. It’s the basis for the movie Idiocracy.

Quoted from Whysnow:

Making claims like this are probably not the smartest idea when talking about a lawyer... esp one that obviously donated lots of time to chase this for the assistance of many in the community.

Just qualify the remark or form it as a question. Let me provide you with examples.

I believe Hilton has unnatural relationships with hamsters.
In my opinion, Hilton has unnatural relationships with hamsters.
Does Hilton have unnatural relationships with hamsters?
Was hamster porn found on Hilton’s computer?

Hey now, that remark could be deemed libelous. Change that exclamation point to a question mark and you’re all good.
