I think some people are confused. Infringing a patent or other IPR is not a crime; infringement is always handled in civil court. It might bankrupt you, but you won't be wearing orange. However, claiming to have a licensing agreement when you don't is Fraud; that is clearly a crime.

I think people should leave the vendors and workers out of the discussion, whether it's minimum wage guys wiring cabs or a company selling cabs or pop bumpers to Skit-B. Discussing a "claw-back" of their earnings is crazy IMHO. These guys had the foresight to get their money up front (hopefully) and they haven't done anything wrong.

Predator and Magic Girl get discussed 5 times more than IM and MET, which have shipped thousands. How can that be? Even if those projects had gone as planned, there would be less than 500 of those games.
