Keith brought up all the dirt that was dug up such as games at his home, games on route. Obviously all the digging people have done was worthwhile and helpful.

I think he thinks playing dumb is going to work. He's basically said, "Here's my bank records, see, no one million dollars anywhere!"

He's tried ignoring the whole thing and the US Marshalls showed up to remind him that won't work.

There's a PayPal record of transactions. Some people sent him a check. I doubt anyone gave him cash, so it is all traceable. There are records of him buying parts from vendors and them shipping parts to him. It may take a lot of work to dig it up, but the info is out there.

One thing that struck me is he's very smooth. He knows what to say and what people want to hear. That's probably how he was able to keep this charade going as long as he did. He'd be more successful at his schemes if he didn't constantly wear that stupid beanie cap and didn't look like he rolled out of bed 5 minutes ago.

The entire time I was listening to the audio I was wondering if he was wearing that stupid hat.

Not only can he not explain where the money went, it appears to be that he doesn't want to explain where the money went because it went somewhere it shouldn't have gone in the first place."

Can someone comment on this? Is this stay a normal thing when something like a bankruptcy discharge happens? Why was there a stay that prevents collection of the debt in civil court? It seems like the expectation is that it will be lifted and then his assets will be pursued in civil court. Or am I not understanding this correctly?

The US attorney seemed to think aspects of the case seemed fraudulent, but that probably pertained to the bankruptcy petition and not necessarily anything criminal on other fronts. But as others have mentioned, it makes you wonder if the possibility of criminal charges might be reconsidered now that more details have been drawn out.

Thanks, that was informative. I understand why a stay would be granted when someone files for bankruptcy. But I don't understand why one would be granted when the bankruptcy was discharged unless this is just an automatic thing in such cases.

Question for you lawyerly types, once a default judgement has been entered like this, is there any way out of it? Is there a way to appeal? Or is it a done deal no matter what and the RV, CNC, and printer are now the property of the trustee? I'm guessing when you don't bother to respond that you severely limit your options.

I not only learned the difference between judgement and judgment, I also learned an easy tell to be able to determine if someone is a lawyer.

If Kevin had not gone down the road he did and defraud so many individuals, people would have been there to help. He'd have had a community of pinheads willing to chip in and donate time and money. But now he's only getting disdain and his antics will probably get further scrutiny once more attention gets paid to the family and their "plight". You reap what you sow.

Since none of the lawyers have chimed in, and keep in mind I'm not a lawyer in any way, here's what it looks like to me.

Case 16-21030-dob is the main Chapter 7 bankruptcy case. Case 17-02001 is the request for documents from Tim Fife, defendant by Randall Frank, plaintiff (Keith is the trustee). IIRC, Tim Fife wanted Keith sanctioned for comments on Pinside among other things. It looks like things got put on hold while that was going on, and now everything is reopened so that sanctions can be determined and issued. So I'm guessing Keith is going to get his hand slapped.

Anyone? Bueller?
