I sent an email on the 11th requesting a refund and I got a similar response on the 14th. Still waiting on my refund as well.

I have not been refunded yet, going on three weeks now since my request. I have sent another request this morning. I got on the list seven months ago, so maybe I have a chance at doing a charge back, I'm not certain at this point. I really wanted to give Kevin every opportunity before doing anything rash though.

I know a lot of people are throwing their hands up and just admitting defeat saying the money is gone. But you should at the very least contact your credit card company (if you paid that way through paypal - and you should have).

For anyone thinking of doing a chargeback the rules are generally listed as six months, however there are exceptions and extensions that can be tacked on. One extension being for pre-order products that are being hand assembled. And this most certainly falls into that category. For guys that have the money to blow, great, wait it out and see if you get that last minute hail mary. But for others who are on a tighter budget, do not wait any longer, at least make that call and see what recourse you have.

Paypal is a dead end as they will do absolutely nothing after 180 days unless they hear from your credit card company.

This is info I was given by one of the big banks. I'm sure each bank has their own set of rules. But everyone concerned should at least make that call for their own peace of mind. And be persistent, ask for a higher up if need be.

Does anyone have first hand knowledge (FACTS) about how the credit card chargeback process will work through Paypal? Maybe you know someone who works for one of the major banks that could shed more light on the subject.

I would think, best case, the money is held in the Paypal account and Paypal will side with the CC company/buyer. Worst case, Kevin has withdrawn all the money and spent it or moved it to an isolated account. Not sure what happens then. Would the CC deny the claim? Or do they allow the claim since it is legitimate, and have their own team of lawyers who will go after Kevin and his assets.

Yes, but what will the credit card company do if the money is gone? Deny the claim of the buyer, or allow the claim and go after the seller through legal means?

Aurich said they should be based on past experience. But I am not holding this as an absolute. With the amount of fraud already committed, anything is possible at this point.

Wouldn't that be nice... But I don't see how it's gonna happen even IF Kevin wanted to send out refunds. At this point he's got pending credit card chargebacks, Paypal investigations, not to mention the criminal side of things with Fox, etc. that are all tangled up into a big mess. Who knows how long it will take to unwind it all. And I doubt it's all gonna get sorted out in a basement.

Does anyone in here have an opinion on which agency is the best to file a criminal complaint for internet fraud with, IC3 or the FTC or both? While I have already filed a chargeback, I have no idea if it will A. Damage my paypal account B. Damage my credit in any way. C. be denied altogether. Also, I'm pissed for the guys who payed through bank accounts, etc. and have their money locked up with Kevin. This man committed a fraud worth close to a million dollars, and the silence is unacceptable.

I seem to remember at least one person on here saying that paypal closed their account after a chargeback, due to not following paypal rules for submitting a claim within 180 days. Though they didn't give any further specifics on why they filed the chargeback to begin with. And maybe the claim was not as black and white as this one.

Maybe once they confirm a fraudulent account, they are allowed to release some vague info to those other account holders who were impacted? Or maybe someone new didn't know what they were doing? Hoping for the best either way.

I just checked my paypal account also and it says:

Step 7 - Case closed
The chargeback case is closed because there is insufficient evidence to dispute the chargeback.

Transaction date was: 08/16/14, chargeback date: 03/11/15.

I originally filed a case with paypal which denied it immediately, and then went to my credit card. Now just hope to see this bum in jail and I will be satisfied.
