Quoted from DevilsTuner:Anyone wondered if Fox sued the shit out of him and took all the money?
No.

Quoted from DevilsTuner:Anyone wondered if Fox sued the shit out of him and took all the money?
No.
Quoted from Whysnow:If anyone wants out, then get out.
I think that's the issue, same with JPop.
Quoted from DCfoodfreak:Stop it! Go away. Not the time or place.
I was going to tell him to fuck off, but you're so much nicer.
Quoted from frolic:Probably a not-so-insignificant amount of money has been spent on title #2, that came from Predator money, but at this point you have to accept reality and take whatever is left.
That's true. My blind cousin did the artwork for Experts of Disaster, so some of the money has already been spent.
I wish Aaron was still participating in this thread, if only to shed some more light on the extent of the license involved. Has anyone actually read it? Please tell me this "license" for Predator is not simply based on a phone call to a Fox rep.
Quoted from YKpinballer:He already said Kevin basically had a letter describing the terms of fair use for people who do not have a license.
Un-f%^king-believable. Just re-read Aaron's post and just cannot believe that's what he was saying, but it seems you're right.
Quoted from Aurich:You'd be surprised at the random PMs I get. This is the curse of posting too much on Pinside.
PM sent re: tentacle porn.
Quoted from Aurich:I won't share the PM, but they're into some kinky shit in Kansas!
You wouldn't believe how hard it is to find tentacles on the plains.
Quoted from nintendo:Who is "kaneda"? I mean I know he's a pinsider, but what's the story with the guy? His name pop's up quite often without any reason. Back story anyone?
He was voted 2014's Most Punchable Pinsider.
Quoted from MaxGain:Typical example of someone wanting drama. No drama there? Then someone tries to create it. That is one of the things wrong around here IMO. I will not even waste my time responding to length of membership here. You have no right even questioning it. I have done nothing wrong, insulted nobody...yet people like you will try to, "Dig Deep" and jerk a reaction from people in order to fulfill your drama needs.
Look elsewhere please.
That's a lot of righteous indignation for someone who's only been here a week.
Quoted from PEN:In other pinball news..... jonnyo gets 30+ thumbs up.
Agreed. Robin needs to add a mic drop emoji so we can add it to the end of jonnyo's post, then just lock the thread.
Quoted from TigerLaw:Does anyone know if Kevin has an actual job?
Is punk rocker a job?
Quoted from TigerLaw:Go kick his ass sea bass.
Can a pinlawyer explain this to me? I just don't understand all this complicated legal jargon.
Ooh, ooh, something from Kevin that finally I believe:
“When I had tried to work something out directly with them, it’s hard to put a real term on it, but, I don’t know what I’m doing. You know what I mean? I’m not a licensing guy."
Let's not forget that Kevin was using the interstate highway system to transport the prototype from show to show. Let's go after the Federal Highway Administration, too, as it also facilitated illegal activity.
Quoted from vid1900:Here is Anderson Cooper interviewing him (beyond insane):
Is that Buster Bluth?
Quoted from playernumber4:The Michigan Attorney General is Bill Shuette. He hates the thought of the legal medical marijuana laws that the people voted for. He is more known for ordering police departments to think of creative ways to arrest legal cardholders and charge them anyway. He even ordered one department to send a copy of any police report involving a legal cardholder to their local gun board if they had a CCW. He tried getting a copy of the names of of the cardholders to every local gun board in the state to try to get their CCWs pulled.
So unfortunately our State Attorney General is probably not the right person to give a crap about a financial fraud involving pinball people. He would probably try to ban pinball if he could too.
Sounds like a piece of Shuette.
Quoted from The_Gorilla:I just wanted to check in. I only started reading this thread 2 days ago so I am on page 110. I feel devastated for many of you. I hope when I get to the end of the story, there is SOMETHING positive that happens for the buyers.
Ever see one of those movies where everyone dies in the end, like Frozen?
Quoted from RobT:What are you talking about??
A Judge isn't going to defer shit to a criminal case. He will hear a single civil case on it's merits. There is no legal basis to say "one must be completed before the other".
If Kevin files for bankruptcy, that's a different matter.
Are you an attorney? Or did you just sleep at a Holiday Inn Express last night?
I prefer this:
lebowski.jpgEither or both may be represented by an attorney. The attorney(s), if any, will not be court-appointed in a civil case, and will not be free.
Quoted from TigerLaw:Also, are you allowed to send out discovery questions (interrogatories, requests for production of documents, answer demands, etc) in the forum you have sued in?
Let's have Robin open such a subforum for discovery.
Quoted from RobT:Indeed.
Would love to see the look on his face when he receives Interrogatories/Demand for Production of Documents asking him to produce any and all documents in any way related to or tending to show that he had (has) a license to make Predator at any time in the last 3-4 years.
I think his answer would be a print-out of the Wikipedia entry on "Fair Use."
Quoted from TigerLaw:Is there a benefit and if so what is it?
Avoiding removal to federal court?
The ones I can think of:
TigerLaw - litigator?
RobT - litigator, I think
DCFan - works at the USPTO
StevenP - IP
Razorback - invented the class action lawsuit and bankruptcy court system
me - small town pizza lawyer:
Quoted from stangbat:How could you forget iceman44?
Certainly a glaring omission. He keeps such a low profile that I briefly forgot he was an attorney. Sorry ice!
Quoted from TigerLaw:I'm a commercial transactions and regulatory compliance guy with a healthy splattering of oil & gas and gaming law mixed in. It has been some time since I've personally been inside a court room other than as an advisor on commercial law issues.
Yeah, I was not confident in my guess. I do think RobT and Gambit are litigators though.
Quoted from asay:WHO GOES TO SEARS PHOTO STUDIO WITH A STRAWBERRY DAIQUIRI AND THINKS IT'S A GOOD IDEA
Maybe this guy?
unclerico.jpgQuoted from spfxted:No, no, no! Proof that he planned to con people right from the start! BIG difference.
The DA will care, but that's completely irrelevant for buyers trying to get their money back.
Quoted from KeithinMI:You should call me Duane and discuss it.
Shirley you can't be serious.
Quoted from RobT:...and yet I can only imagine the bashing that people here would have given Stern if they came out and claimed that Skit-b didn't have the license for Predator.
"Stern is trying to kill the competition" and "they have no morals, this is BS tactics" etc.
Milton would have been furious.
Quoted from TigerLaw:Returns are signed under penalty of purgery...
*Perjury. Kevin will be purging once the IRS gets involved.
Quoted from Brickshot:Interesting this was filed today? Aren't all government entities (including the courts) on holiday today? And who the heck is working today anyway, lol. Keith?
Sounds like a lengthy list of big, big wishes. Like VirtuaPin isn't going to fight this tooth and nail? How many hours does Keith get for fighting that battle in the courts with them? That is not some quick decision from the court and not just a couple of hours of Keith's time.
"Better to remain silent and be thought a fool than to speak out and remove all doubt."
-Abraham Lincoln
Quoted from wolftownjeff:350$ a hour is nothing in Charlottesville VA for a good lawyer. Could easily hit 500$ an hour.
Those fancy Charlottesville attorneys even put the dollar sign to the left of the number.
Quoted from Brickshot:Who could I possibly be that would make what I just posted any less true? It's like Groundhog's Day around here. Can't attack the argument, let's attack the person.
You're parroting a lot of what Tim Fife said - that it wasn't worth it to go after Kulek, his vendors, or those who ended up with examples of The Game.
Quoted from Brickshot:5 months of posting without a single boot from a thread or even a timeout or reprimand
Congrats?
Quoted from Brickshot:Using a copyrighted image for the purpose of parody, criticism or explanatory or educational purposes
Ahem
Quoted from Brickshot:Who could I possibly be that would make what I just posted any less true? It's like Groundhog's Day around here. Can't attack the argument, let's attack the person.
Ahem
Quoted from Whysnow:ANYONE that believes a single line of what Tim Fife is selling... has not read the depositions.
Amazed that some of you are taking it from him on faith. The guy is every bit as culpable as the rest of the crew and has been the exact opposite of cooperative thus far. His life will continue to be made more stressful unless he decides to take a different trajectory (would be very unexpected based on how he has been so far).
I'd like to read those so I can be informed.
Quoted from fastpinball:This is a photo of EoD in the crate just before it was shipped back. The game had borrowed some mechs from Jimmy's X-Files and he was eager to get them back. It was returned with no FAST hardware with it.
Damn that art is vomit-inducing.
I posted this a week ago and Robin still has not stickied the thread:
https://pinside.com/pinball/forum/topic/interest-check-items/page/2#post-3514250
Should I contact the FCC next? Or should I expedite it to the International Court of Justice at The Hague?
Quoted from c508:Yes... I do realized it is "perjured" no more PMs necessary. I do like "purgered" more now due to the mental image of Kulek "purgering" his pants
PM sent.
Quoted from Coyote:Hey, legally, Wiccan is a religion. Just sayin'!
Back on-topic, re: Kevin's Operator business - wouldn't there be a tax record? Doesn't Michigan or the county there require a license and yearly fee for games/vending?
Friendly wager that he didn't register and pay for such a license?
Quoted from BackFlipper:Excellent!!! Two Brothers is a great local Microbrewer. If you look closely at the top of the can, it says "special when lit." Really a nice touch.
It's also a nice Rick and Morty reference.
$7K seems quite reasonable for the great work Keith has done so far. I'm a bit surprised the number is that low considering all the time Kulek has wasted.
Quoted from KeithinMI:The Ender's series of books were great. The movie was ok, but disappointing. But then again, isn't that true about a lot of books and the subsequent movies?
On a different, but similar note -- If you haven't watched The Expanse on SyFy, I suggest you watch it from the beginning (Season 2 just started recently). Season 1 is fantastic, I'm not particularly loving season 2 and it may have jumped the shark. However the books by James S.A. Corey are great and if you read them, read the short stories that go with it to fill in some of the back-story (such as the Epstein drive).
Let's stay on topic. How does it compare with The 100?
Can anyone name this movie without searching?
"The crickets and the rust-beetles scuttled among the nettles of the sage thicket. "Vámonos, amigos," he whispered, and threw the busted leather flintcraw over the loose weave of the saddlecock. And they rode on in the friscalating dusklight."
Quoted from Latinfantom:Im probably wrong but I hope it's The 3 Amigos. "Lip balm?" LoL.....Classic
No, but I love that movie.
Quoted from Yellowdog:By the time you add wiring, power supplies, boards, parts and accoutrements, where was the profit going to be?
Remember when Kevin declared Skit-B a nonprofit?
Quoted from vid1900:The Canon 1200mm gives me the reach I need when peering into other's lives.
My boss says Canon only make 2 of these a year, because the crystal for the optic takes forever to grow.
Have you considered just buying a Hubble?
Quoted from vdojaq:Sorry, Pinside is not your personal safe zone.
You should probably throw all of your TV's out and leave the internet.
Please include a trigger warning next time!!!
Quoted from benheck:if you or your friends are good looking enough your pics can get resold as stock photos!
This is about the kuleks. You are going way, way off topic.
She sounds like an amalgamation of every Kristen Wiig SNL character.***
*** Please don't sue me, miss litigious!
Quoted from TigerLaw:He said on the record he found the parts in a box by his clubhouse? That's not a joke or hyperbole of some kind?
The box fell off a passing truck.
An even better idea: What if Clay were to pay $500,000 for the Predator prototype, and then all preorder customers get fully refunded? Under this plan, nearly everyone comes out ahead!
This might be worth a read for some:
Quoted from benheck:Hilton don't forget Mythbusters.
Most licenses won't get out of bed in the morning for anything less than 50k and they usually want it up front.
For Star Wars, sure, but how many people were lining up to license a generic version of Mythbusters?
Quoted from frolic:I don't think Jaime Hyneman showed up at CAX just for love of pinball.
I bet I could get him to show up for less than $50K is all I'm saying.
Quoted from Concretehardt:You can write off a portion of it on your taxes..
https://practicaltaxes.com/can-you-write-off-money-you-lost-in-a-scam/
It was a borderline call a few years ago, but you can't do it at all for 2018 and beyond. Theft losses are no longer deductible.
