It's always easy to second guess and apologies to Keith for doing so.. I disagree with the above. As someone earlier mentioned the hearing should be in a courtroom. You are wasting another two weeks and at least if it's in a courtroom, the no show or uncooperative behaviour can be dealt with expeditiously by a somewhat sympathetic judge. Maybe there are other tactical reasons that I am not seeing but to this armchair league beagle, it feels like an odd decision.

The end game here is to not allow Kevin's debts to be discharged. I believe Kevin is well on his way to doing just that. Keith is just helping him sink his own ship.

Judge basically said he was going to throw Kevin in jail if they had it at the courthouse.
Given that at the last hearing Kevin claimed he had ZERO business records, I'd say some jail time would have been a cert.
Time to buy stock in Schadenfreude Inc, there's going to be a lot of it once Kulek gets incarcerated.
When something crappy happens to you, you'll be able to think hey, at least KK is where he belongs.

How do you not have access to an email account, especially one used for business? (unless he used the predator domain for email). Probably should have exported all your emails before you decided to let the domain go.

Seems logical to me, Kevin Kulek stole money and doesn't intend to repay his debts, so he chose to file chapter 7. There are many thing Kevin does not understand ... little things like ... honesty, licensing, how to run a business and voluntary bankruptcy. Kevin's dishonest actions and lack of integrity have hurt many people. The wheels of justice turn slowly and things are finally coming around - KK is the victim of his own karma, and many bad choices.

hint - you don't. That was only his excuse.
My guess is he "torched" everything (emails bank account etc) around the same time as the website purge or no later than the IP issues becoming public.

On the radio here not too long ago they ran a story that a local "contractor" was busted taking "deposits" for promised work and ran. He got 30 years, although it was a second offense.

Yep. Guilty as charged. The red flags went up but i waited too long. That turd stole a lot of money from me but not enough that it will cause a hardship. If it did, that would be a different story. In any case, one way or another that liquid squeeze bag Kevin will get what's coming to him.

I've been home sick watching tv and saw an interesting show comparing military prison vs civilian prison.
It seems Military prison has very little fighting, forced hard labor (breaking rocks for railroad track beds), and no ass rape.

A default judgement has been entered in the associated case against Paul Maletich/Virtuapin.
They've been ordered to immediately surrender a CNC machine and a large format printer, with a money judgement for $155,000. Whatever the CNC and large format printer get sold for can be applied to that total judgment amount.
It was also ordered that Virtuapin turn over all documentation relating to any transfers between SkitB and Virtuapin.
As much as I don't think they were completely in the wrong, that's just their fault for not answering the original summons. Huh.

Yeah, this was discussed before, I believe. In my work with artists, usually the contract I have to sign with them (the artist; I have *no* artistic ability..) includes a clause saying I'm solely responsible for any lawsuits coming up via lack of copyright ownership, which protects them. I'm very, very surprised they didn't do their homework.

Question for you lawyerly types, once a default judgement has been entered like this, is there any way out of it? Is there a way to appeal? Or is it a done deal no matter what and the RV, CNC, and printer are now the property of the trustee? I'm guessing when you don't bother to respond that you severely limit your options.

Agreed. From someone who claimed to be SO innocent, then never answers a subpoena that pertains to his exact claimed innocence, is quite fishy and telling.
