Just dumping her when she ran out of money is a problem for criminal defense lawyers here and its even worse if they didn't make the settlement applicable to all counties/parishes (I understand they have no power to stop the Feds from coming after someone but one county can stop other same states counties from trying someone for the same thing...).
Maybe Kevin thinks he found a loophole in the court paperwork and doesn't need to show or produce anything.

Why are the years off by one in the body of the Affidavit in post 12090? Notary's are supposed to catch stuff like that. Maybe she should have stayed in a Holiday Inn Express last night.

So how long is a court appearance where his attorney is there but he isn't? Did the dude even say why he can't respond outside of a court? Probably won't bother because there is nothing left to bill against. If not, how awkward.

well we already saw it.. he is asking the court to find Kevin in contempt of the court and issue a warrant to bring him in and detain him.
Which would mean the next question is.. when/how/why do the Marshals actually go out and try to execute a warrant like this for a non-violent criminal. Or do we have to wait until he crosses the law and someone runs his name.

Wow, so his lawyer gave no explanation at all for Kevin not showing? Why did the lawyer even bother showing up? I'm assuming Kevin has no money to pay him either so I'm confused why he would go unless Kevin asked him to specifically? But it sounds like nobody can even get a hold of him. Just a weird story. Kevin probably could have gotten away with no legal repercussions but now he has made this a clear criminal matter and it can only get worse for him unless he starts cooperating.

If you read the document, it says that Kevin didn't tell his lawyer he wasn't coming.
Just using a common sense guess, his lawyer probably advised him to come. Probably said to meet at Keith's office and Kevin didn't show.
I imagine it went like this:
Keith: "Hey Kevin's Lawyer, thanks for coming."
Kevin's Lawyer: "Kevin should be here shortly."
*45 minutes pass*
Keith: "I guess he isn't coming, did he tell you that?"
Kevin's Lawyer: "No."
Keith: "OK man, you know the next steps, we will be in touch."
Kevin's Lawyer: "Ok, later, see you around."

I would suggest you review docket item #34 in the file to see what the Court decided to do. Perhaps some fine person on here with PACER access would like to put it up in this thread.

Lawyers are not merely client advocates. They are also "officers of the court." Attorneys owe a duty to the justice system; hence, Kevin's attorney was duty-bound to attend the hearing, even in his client's absence and despite the lack of payment for his time (if applicable). Likewise, attorneys are not permitted to intentionally call a witness at trial to proliferate a lie because doing so would be suborning perjury.
One may analogize this higher obligation to that of a psychiatrist, who is compelled to breach the physician-patient privilege when imminent harm may come to a 3rd-party, if that psychiatrist were to remain silent about the impending threat.
Now that there is a warrant, there needs to be some reason for the cops to visit his home.

Back when people used to still write bad checks, Ali at the local party store would get a warrant for someone's arrest.
Of course the cops would only act on that warrant if someone was pulled over; otherwise it was not something they wanted to get involved in.
Ali found out that if you make sure Mr Badcheck was home, you could call the police and say you hear what you believe to be Domestic Violence at his address. This would result in 4 cops showing up, ready for battle.
The cops would interview each household member separately, and have plenty of time to discover the outstanding warrant.
Wouldn't the US Marshals actively pursue a warrant, unlike the situation you describe with local cops?

Simply put.. there are thousands more warrants out than there are people to actually go and proactively enforce each of them. Which is why there is priorities and some logic about when/who/when to go and try to find someone.

Even if its only a detention cell until he can be brought before a judge... the very idea of him being in a cell, even if only briefly, is a moral victory. Plus, the idea there is actually an active warrant is also a star on top of the christmas tree. The idea alone that the guy is actively WANTED by the law and will be held in a cell is a huge step forward.
It's wacky to think that outcome finally comes from his civil disobedience instead of criminal charges... but you gotta take what you can

Did he ever get paper mails(in addition to emails) to show up for legal proceedings? I'm wondering if he just tossed them out like it was an overdue bill he ain't going to pay. Interesting to watch someone just completely ignore it all to see how far it's going to go.

I'll bet he never got served by one of the typical Process Servers in Michigan who are "trusted" to provide "good service" to the attorneys or Courts that pay them the usual $125.00 fee.
They come knocking with their little badges hanging from their belt with "Court Officer " ID. And when there is no answer after a few attempts, they tape the notice to the home or apartment front door and "Certify" it was delivered or served.
There is a good chance Kevin never even saw it if he fled to South America or someplace like that.

Well he has a lawyer... that presumably knows how to reach him. If he refuses to listen to his own representation.. there is no excuse.

I normally love advice from vid, that said, this is awful and highly illegal advice that could get someone in a lot of trouble.
Each state is different, but reporting a false emergency is a felony in every state I have seen (sometimes it is a misdeemener that elevates to a felony when someone, including the cop, is injured). If you report a knowingly false act that has an emergency vehicle show up and someone gets injured you have liability and will likely go to jail yourself.
A lot of dogs have been shot over the years when cops come storming in someone's home over basically a prank call. Some cops have also been killed...the person triggering the event has some liability here.

Well, that's certainly a very nice Xmas present. At least i can sing 'bad boys' all day long and feel better about all this. It's not over yet, but hearing news like this goes a long way.
