this is not a slam-dunk in either direction. plenty of folks assert that piracy is what spreads the word of music and films, massively increases their exposure and so directly leads to *increased* sales to the people who discovered it via a borrowed tape or downloaded copy. having said that, i agree that stealing the IP of a small start-up business probably takes food off their table at a time when every penny counts. but a behemoth the size of Fox? never. they would likely reap the benefits of free publicity by piracy.

Taking something without paying for it is DRASTICALLY different than stealing...
This might be helpful for some. The "P" in "IP" stands for property, kinda like a car, TV, ipod, phone, house are also property.
That having been said, I have had a chuckle at all these mavericks and rebels breaking the law by playing pinball machines that may have IP violations. Wow, the next thing I'll hear about is how some of you looked off of someone else's paper at school or even stole a beer from your dad's fridge when you were only 16! Heck, I bet some people even inhaled! I'm not sure I fit in with such a rebellious crowd.

Seriously, I won't pretend I have an absolutely clear record, but I am embarassed by the number of people/families I know who make over 100K a year and still can't be bothered to pay for the IP they steal.
I figure if it a piece of entertainment, and I actually want it, I should you know, buy it with my money.
Put another way, how entitled to I have to be to STEAL something as trivial and abundant as entertainment in North America? It is not as if it is going to save my life, or as if I don't have a substantial amount of other choices that don't involve ripping other people off.

All I know is it isn't mine and that makes me sad.
Just talked to Paypal and no way they are going to refund is what I am told. So paypal not via credit card and check people will have to take legal action against Kevin.
The thing with a lawsuit is that in Michigan small claims court can go up to $5500. I want my $4750 back, but if I have to buy a plane ticket and take two days off of work, then I'm going to go after the $5500. Guy just needs to issue refunds before it gets worse for him.

Would be easiest for everyone, but if Kevin doesn't have all of the money to refund (which seems extremely probable) there's no obvious way for him to proceed. If he refunds 50% to each buyer, he'll just have a bunch of suits for $2.5k instead of $5k on his hands. Hard to see any road forward other than for this to play itself out through small claims and/or bankruptcy.
Only problem I have is that if he has a lawyer, then he can request it be taken to real court. Then I would have to get a real lawyer, and since I'm the plaintiff, I don't think that entitles me to a court appointed attorney. Then I'm already out half the money. Then it would be multiple days, multiple plane tickets. Then even if you win, you still might not get paid. What a mess man. I just want a damn machine in my house so I can stop getting hammered every time I want to play!

This would be the most frustrating part in my mind. To go through all the work, headaches, and MORE money (for lawyers, court fees, travel, whatever) and in the end you may still not get anything back. Because ultimately, I don't see how Kevin avoids declaring personal bankruptcy.

I've started researching Michigan bankruptcy law and want to make sure everyone is aware of the laws regarding non-dischargeable debts:
The following debts may be declared non-dischargeable by a bankruptcy judge in Chapter 7 if the creditor challenges your request to discharge them.
1.Debts you incurred on the basis of fraud.
The list goes on. But this is a breath of hope.

Better than nothing I guess, but even if the debts aren't dischargeable, you're left trying to collect from someone that just went through bankruptcy, presumably shedding most of his assets in the process.

Well, that's a pretty sanitized version!
Admittedly, "collection of reasons" sounds better than "lied and defrauded."
However, I would take issue with your first point as well. Knowing what we know now, it seems implausible that he could have EVER made these games even without the little detail of lying about the license.
So, no-one has heard anything more from Kevin.
I'm going to call Paypal again in the morning and see if obtaining a crime reference number will help.
Paypal DO have a part to play in this. They have the power to freeze the account and give people money back.

The money is gone. Kevin took it. PayPal does not have it. They did not defraud anybody. They did not promote his game on Pinside. Keep your eye on the prize. It is Kevin. If he did not gamble it away, he converted it to cash. He is not stupid (contrary to what some believe).

Well, I hope you talk to the same "paypal lady" thats Whysnow spoke to. She defintely seemed to be the most informed 1st level customer service person Ive EVER heard of.

I once sold a remote control airplane to a local guy who was deployed overseas. He had paypalled me the money a couple of weeks before and asked me to hold it until his wife could find time to meet up with me to get it.
After a couple of weeks I just went and delivered the plane to his wife at his house. Afterwards, he told paypal he never got it and they took the money out of my actual bank account because I had already transferred it.
I called the guy and asked him if he was stupid, because I had been inside his house and met his wife. After a short discussion, she met up with me to give me the cash.
Getting a judgment is a waste of time and money since he is probably judgment proof.
As far as a criminal complaint that is up to the DA since it is a crime against the state and not the people that were defrauded.
If it did go to trial and he is convicted the lawyers, courts and state will get the money not the victims that were ripped off since the legal fees and fines will be more than the amount recovered.
The taxpayers will get ripped off further paying for his 3 hots and his cot while he does his time if any since they are more concerned with getting their hands on the money than the outdated concept of justice.
Our system is so broken, first you get ripped off by the perp then you get ripped off again by the courts.
Best thing sorry to say is just suck it up and move on.
