The reason DP hasn't paid isn't inferred or implied in that mail at all... it simply states a credit dispute.

Even if it's true and correct, that could mean DP isn't willing. That could mean isn't able. That could mean isn't willing or able.
If DP has the money and isn't willing to pay the ARA statement, "is not willing and able" is true. You are misinterpreting "not willing and able" to mean 'neither willing or able'.

The additional possible translation/second language issues further confuse the question on what ARA truly means.

It's not realistic to think the FTC will be interested and able to sue DP successfully. Nor is it beneficial. You're likely to get far more selling your spot to speculators than you would from any FTC action.
