That would definitely suck for the new owner... IMO in this case both the new owner and original owner should share in the loss somehow. The original owner get his game back but should some how compensate the new owner until the thieves are located.

The original owner has no fault in the matter? Maybe or maybe not in this case but in many cases some things get stolen because the original owners do something stupid like leave a pin in the back of a pickup overnight at a hotel parking lot which I've seen. If that owner gets his machine stolen and an unsuspecting buyer buys it there is no way I would think that new buyer should be out everything. It would be a case by case thing but if the original owner was very irresponsible why should the unsuspecting buyer get hammered?

The unsuspecting buyer would probably have to go after either the seller that sold the stolen game, or the person who originally stole it--either small claims or a lawsuit.
When buying a modern game, it's probably worthwhile to do a quick search for the serial number on Pinside and ipsnd.net

That is the way the law works I just know I would do something for the unsuspecting buyer if I were the one that created the issue... again not saying this is the case here but in many many cases the original owner basically creates an easy opportunity. Someone else becomes the victim of his irresponsibility. It happens all the time unfortunately...
