Why have you not disputed the charge with your credit card company yet? Do it now, case closed and you'll get your money back because they won't be able to provide proof of delivery.

I have never heard of that. If someone does that it's due to their own company policy. There is nothing illegal or wrong about charging a card prior to shipment.
