It's way passed that. Apparently, cease and desist letters were ignored for one. And if you were Fox, and you understood the potential licensee had already guaranteed product to pre-orderers, guess what happens to the price of the license?
Another party reviewed their finances and at the cost of the game ($4750) they were barely breaking even, even without the license AND if they built them all themselves. And who is going to give another dime to them?
None of the artwork has been approved. It might need major revisions or completely new art altogether.
