I'll answer my own question:

Interesting history based on the legal events.

Draw your own conclusions.

Quoted from pinlynx:

IIR, the two prototype Pinball Circus machines were built using spare Terminator 2 cabinets.

They would have had to seriously rework the cab then...

And what about production tooling, creating a second production line, the next game after PC, labor costs (training, staffing). I can see given these issues, a higher BOM cost and how it tested why it didnt get the green light.

Quoted from master_of_chaos:

Maybe a silly question:
In the patent drawing , there is a foot pedal for controlling some features.
Is this pedal also included in the 2 existing prototypes?
I cannot find any footage about this.

The patent drawing also has glass on the side of the cab making it easier for onlookers to see what's happening. The proto does not. That's another cool feature which I'm sure added to the cost.

Quoted from SilverUnicorn:

Just wondering if this might make an appearance (even if not fully working) at the Allentown show.

Even if it does make it to the Sanctum, probably the only NIB game I can see myself buying in the foreseeable future.
