Deathmath against Bowen on pinball machine of her choice. If Jill wins, she'll own all the games inside PAPA building. If she loses, she must sprint through parking lot and safely arrive at the street, without stepping into a hole and twisting an ankle or getting run over. Pay-per-view $50 fee to watch the I'm Hungry Games.

    Quoted from o-din:

I get the picture now. Just think if she'd been using the flashlite that came withe her phone instead of seeing how many likes she got in the last hour.

I remember reading aboot a case similar to the pic of open cellar doors. It occurred in NYC about 7 years ago. Person was texting and walking down sidewalk. They fell into open cellar doors abutting and directly over the sidewalk where vendors keep their store surplus. Case was awarded to the distracted walker stating the store should have had a person stand by the open doors and should have coned the area off too. In that case, I had sympathy for the walker, who wasn't totally blameless, but was put in harm's way by a negligent store owner. A parking lot with pot holes and uneven pavement shouldn't be cause to sue.

While we're killing time, I thought of a hypothetical. Let's say Jill was exhausted from a ten hour day playing pinball and was on the way to her favorite watering hole. It might be close by and she is really looking forward to going there to unwind. Did she trip and become injured after leaving the PAPA event, while walking through a private parking lot as a means to go home or because she was in a hurrying to get to her car so she could drive to her watering hole? One suggests the parking lot was a link in the chain of events for PAPA, the other is a link in the chain of events for traveling on to place#2. Maybe the place she was heading next shares the blame. any premise liability lawyers in da house?

It's often entertaining and sometimes it's worth the price charged.

I'm not sure about you or anybody else, but I am real curious what other random elements beside a pothole caused somebody to get injured when so many other people have walked the same path without any issues.

I don't see any exposure for PAPA. She parked in a private lot. The owner of that lot likely has posted a - park at your own risk/you assume all liability for damage to your person and your car - sign and has insurance. What am I missing? From PAPA's pov, it doesn't matter where she came from or where she was going, right?

^^ Since victim fell on private property, I maintain PAPA has no exposure. Now if she was smart, she should have hobbled to the PAPA parking lot and proceeded to trip over a parking bumper, thereby twisting her other ankle. THEN! she could have sued the hell out of PAPA. sorry the victim got hurt and hope she recovers soon. If she had personal insurance, that would have covered about 80% of bills. If she successfully sues the parking lot owner, she can recover the rest. For me that solves the mystery.
