He was high on meth and "threatened to kill" someone on the phone and talked some bullshit about hiring a hitman, so let's not get too dramatic. In australia that's apparently a crime. Why is Brian still on the art? Because he didn't piss anybody off he had to quit because of medical issues. And really, nobody wants an AXL/DC pin, plus you'd have to pay AXL. Incidentally the bass player is retired now too, so what they should get rid of him on the artwork?
The reason Rudd isn't on the game is either because they won't have to pay him this way, they hate is guts, or both.
