He has no motivation.
He should've said, "You will receive your refund." and then wait for his own reimbursement when he sells the game.

Yes I completely agree with you.
Although it seems that a distributor who would rather let the customer take a hit because he doesn't want to be bothered, or doubts he can sell the game to anyone else, is not providing any real service.
I don't see it as a long term winning strategy.
