Perfect example. Tell my clients all the time. Follow the corporate formalities or lose the shield! It's not that hard, simple in fact.

Congratulations to all the guys that stuck it out and received some justice. The $$ is one thing, getting a "judgment" against him is priceless.

Does he have personal assets to collect against? Will he file personal bankruptcy?

yes those 4. DP included. it's just for posterity anyway and besides I am curious. Like from my personal perspective I could have had one or two real machines YEARS ago if I had avoided these clowns. I am wondering, for instance, how many REAL machines could have been purchased if all the money those 4 ... groups... had not sucked our collective money down their collective toilets.

I can give you two. One million us at Zidware, and say about 200 machines at average 9k at DP or just say 2m so there is 3m US

That's phase 2 and based on our roller coaster journey to this point, I anticipate it being long and problematic. - So be it as we are a determined group that really hung together on this.

Aggravating at times but always interesting and well worth the effort.

Grrrrrr. Devil's advocate - if one were to collect over a million $ , and then have to give back only <20% , what would you call that? LOTTERY WIN. This is the part I really hate.

Nice you got to him before he filed bankruptcy (assuming that is a likely outcome?)

Have fun going after him for the money! Hope he pays up for every damn cent. Good thing he has a job with Deeppockets DeepRoot. Should be making enough to have plenty extra to pay on his judgments.

This was a civil trial, so he's not considered a criminal in the eyes of the law. Of course, the court of public opinion may have differing views on the matter ...

Is it safe to assume that zidware was never setup as an LLC either? Legally speaking, if you setup a contract and you dont' fullfill it (and can't refund), I assume you are liable personally. I also assume if he can't pay (or get a giant loan or sell off his house), that he could serve jail time for fraud?

It was an “Inc.”. I assume S Corp which means whomever set it up didn’t know what they were doing. LLC the answer for enhanced asset protection and flexibility

The criminal case involving fraud will never happen at this point even clearly at the end of the Jpop party thats exactly what he was doing collecting AIW $$$ knowing that he couldn’t even complete MG.

Yet he certainly kept paying himself

While there might be other remedies available and ways to attack the individual and LLC here it is under Illinois, some states better than others

The reason a creditor doesn't want a "charging order" is because they only get the right to receive the INCOME from the LLC, however, the LLC owners don't make distributions and the creditor ends up with a K-1 for the profits and zero cash to pay the income tax! S-Corp, a creditor can step into your shoes as the owner of the company.

What Is an LLC?
A hybrid of the "S" Corporation and a partnership, an "LLC" combines the corporate characteristic of limited liability with the tax advantages and flexibility of partnerships.

What Protection Does an LLC Offer?
Being a member of an LLC offers more protection to the members interest, which makes an LLC very attractive. A creditor can only get a charging order against a member of an LLC and cannot go after the LLC's assets directly. They must instead obtain a charging order from a court, which is not a preferred remedy for a creditor.

What Is a Charging Order?
With a charging order, a creditor has the right to receive any distributions in which the owner of the interest is entitled to. A charging order is issued by the court and instructs the manager(s) to give the distributions that the debtor would ordinarily be entitled to to the creditor until the unpaid judgment is satisfied.

Illinois LLC Act
At first glance, the Illinois LLC Act appears to protect the assets of an LLC. Specifically, Section 30-20 provides that a charging order is available to creditors of the members of an LLC. More importantly, 805 ILCS 180/30-20(e) states:

This Section provides the exclusive remedy by which a judgment creditor of a member or a transferee may satisfy a judgment out of the judgment debtor's distributional interest in a limited liability company.

I would have loved to be in court, but was represented in absentia. I'm very happy to have been part of this case, and many thanks to everyone involved, and Kim for taking my case (Jpop wanted the cases of those unable to be in court in person, such as me in UK, to be thrown out, so we transferred our cases to plaintiffs who could attend court in person, which the judge accepted).

Jpop literally shat on his legacy and his fanbase in order to make a few (well, quite a few) bucks. He never apologised, and he used NDAs and every legal trick in the book to try to beat us down. This included countersuing the plaintiffs TWICE.

Really unimpressive, so I'm delighted that justice has finally prevailed. Let that be a lesson to others out there! We will pursue you until you face justice, and the truth will out.

Way to go everybody that joined the suit and hung together. Based on comments from deeproot during the ordeal, I wasn't sure this win would be so decisive. getting paid will be icing on the cake, as the win is the win. Wishing some of you use recovered funds (once they appear) to purchase another pin, after all you were trying to buy a special pin. Treat yourself to an MaidenLE, AFMr, MMr, JJPOTCLE, Houdini or ACNC instead. Of course you must throw a big ass party, take lots of pics and post them here.

Who knows. Can Deeproot use his designs? Does he need to liquidate his house and live in a van? Will this post hit 24 K? Will anyone buy a Deeproot pinball machine? Only time will tell.

I do want to go after Heighway big time. Maybe we can.

hmm, sounded like they were saying that the rights to the games reverted back to jpop from Bill Brandes when the completed games were shipped. If the courts have now ruled that jpop did not ship complete games and accordingly would not have met the requirement, then the view from the cheap seats would seem to indicate that the rights have not reverted back to jpop and still belong to Bill. Not sure what rights were involved, but either way, I'm sure the arrogance of deeproot is that they still have the rights to move forward, but suspect Bill, who was already saying that jpop had not fulfilled the requirement, case, now has a stronger case.

This is the end of one chapter of the saga, but this story is far from over.

Would have been cool if the court appearance was streamed, sounds like it would have been entertaining to watch.

WOW!! Jpop can now claim whatever he wants, but a JUDGE has decided this! It went to court and his defense of his actions lost. "Ahh shucks, I don't know what I'm doing" didn't hold up! Congrats again!
