Quoted from frankmac:

Looks like Flipping out has a few for sale.

I would consider one if there were parts available. Unfortunately it could turn into a paperweight.

We've had this discussion a few pages back. These games will never turn into paperweights. The electronics are FAST, the flipper mechs are BLY/WMS.

The highest risk in my mind is dropping the playfield so hard that it cracks the plastic - a real concern as the rear of the playfield has wheels and there is no prop rod. But I do think conversion to a wood playfield is possible if required.

Serious the only idiot comment lies with yours.Did Punkin force anyone to purchase a machine? He put money down not like many posters on here that have come over from the pinball is boring thread to throw vitriol around and trying to big note themselves.Others like myself have lost money in the venture.Rather than blaming and putting people down how about being proactive and try to change the way pinballs are sold. That to me is the biggest flaw in the system.

There you have it folks.

Haggis not to blame.

It’s “the system.”

I knew something was fishy in pinball!!

They would have really had to come up with a robust prop for this. The playfield is quite heavy. You need support on both sides at the same time. Even using the single prop on our Centaur at our club feels sketch to me.

Aren't you the guy who sent me a bunch of love letters when I was warning people that haggis could be a scam? Telling me I was an idiot and troll and whatever dumb names you could think of via PM for speaking out? Saying how wrong I was, and that I'd see and feel really stupid when Haggis triumphed over everyone? I, for the life of me, cannot fathom (no pun intended) the level of ignorance it takes for guys like you and gilligan to come in here and keep acting like you guys are being victimized and everyone should just forget about your bad behavior and move on. Its like taking a giant dump and gassing everyone out of the place then trying to act like you're walking through a rose garden. To Punkin's credit, at least he is the only one who hasn't been going around acting like a complete knob after the thing happened that we all thought was going to happen. He's at least keeping his mouth shut, which is better than whatever wacky stuff you 2 guys have been up to.

Punkin talked a good game but when it came time to pay up he ran out the door. Haggis’s fanboy to the very end…

This was on Facebook, a portion of the Haggis "no words" video so I ripped and uploaded a copy:

A lot of people with no words to say now.

Haggis sure had a lot of money to spend on fancy playfield shipping boxes, Christmas ornaments and slick videos. One thing that set off alarm bells in my head.

Honestly I'm surprised he's not on here doing his tough guy shtick but hiding with your tail between your legs is certainly preferable to spewing ignorance

Yeah it has all of our personal information for those of us that paid in full or made deposits. Hopefully it doesn’t get posted here.

I'll bet.

I have been talking to distributors to let them know that FAST is here to help them support their customers on FAST electronics in Fathom. Just trying to find manageable ways to help support those left unsupported on FAST-powered games.

If you are/were a Fathom distributor and we haven't spoken yet, please reach out.

my name is in there.... probably best not to share the doc.
Sorry to a known US distro, thats a chunk... I wonder though if they didn't do the currency conversions properly for USA creditors. The numbers are very round.

Not that it will matter much, the major creditors are listed as themselves, and the amount to recoup is a couple of cents on the dollar....

wow!

So Damian has claimed $1,009,000 for himself.

Common practise in these cases but always pisses me off. Owners/directors should not be allowed to join the unsecured creditors pool with everyone else. They should have another category that sits at the very bottom called "Creditors Directly Responsible For The Failure And Collapse Of This Business That Should Also Be Subject To A Public Flogging".

On top of that he syphoned off any assets worth anything anyway.

Fraudulent.

Not that it would make any difference - there is no distribution coming.

And I cant believe he is still sending out C&D demands to protect his so called "reputation". Honestly, even the most offensive public slander would have to be a net benefit to his reputation at this point.

totally agree in situation like these the law should allow liquidation of the multiple companies that he put things in - like machinery under Hartsco and probably deposits to his Super Fund business (speculation), then go after his property - shouldn't be allowed to run any business... now and in the future.

This stuff is just depressing - no winners in this situation

Reading the list of names and businesses makes me feel sick.

Hopefully it's ok to post this. I have removed all addresses + distributor/personal names and bunched the totals together.

For those that are curious, so the file with everyone's details doesn't get passed around too much

The middle column is what I am guessing the creditor amount is for. Quite a big one being Business fuel - which looks to be a company that provide loans.

Many of us in this thread have likely worked for bosses with questionable morals.
I'm reserving judgement on Marty and sitting on the fence, based on the limited information that we have available as at 1 August 2024. I think that the fairest thing is to not to have a view and be pragmatic, at least until more information is in the public domain.
EDIT: yes the warning signs were there. I'm not saying that Marty has 0% responsibility, just trying to keep the conversation based on what what can be verified vs. speculation

MARTY wasn't 3 floors away from Damien working in some multi tiered corporation. They were holding each others hand the whole way. He knew exactly what was going down.... for a while too. Yet still banged away on his podcast that everything was roses.
Sorry no reservation of judgement here. Based on common sense, facts, and logic.

#9782 43 days ago

thanks for sharing FalconPunch

that is alot of deposits / full payments stolen.....

#9783 43 days ago

$850k to customers.

These sorts of collapses also affect other manufacturers. I know of a couple of definite Spooky sales that were ready to go ahead but had to pull out because of what they lost to this.

Then there is the lack of trust and confidence and general mood in the hobby.

#9784 43 days ago

.

Post removed as I may be misunderstanding some of the information in the document.

#9785 43 days ago

very likely even more than that .... know of a few that are not on the list of creditors ....

#9786 43 days ago
Quoted from visualmagic:

One crazy page in this document is the 'hourly rate ex GST'. How can it be correct that admin is $150/hr, Supervisors $520/hr, Principal $770/hr. There is not a position listed in this page under $150/hr. It must be a mistake...

... wasnt that the lawyers/liquidators fees?

#9787 43 days ago

Yeah, I wondered that - I had to actually send in my proof of creditor. And hence, I am listed. What about those who didn't, would they all be listed?

Man that's crazy. Over $720,000 USD of distributor's and customer's hard earned money gone.

Playing pinball develops fast reaction times!

#9792 43 days ago
Quoted from Stuieb84:

Damian is still continuing to trade under his other privately owned companies that he is a shareholder and director of like nothing ever happened with Haggis Pinball:
* Hartsco Pty Ltd (IT sales & consulting); and
* EME Property Developments Pty Ltd (subdivision and building townhouses).

Could you register a caveat or similar over his development (if you are out of pocket) and make him take steps to remove?

in nz directors still remain personally liable for gst and tax owed by limited company so there is a sliver hope Damian may be held liable for that cost / absolutely heart broken though for those customers that lost their hard earned money - the time line of this one is very curious and I doubt if anything other than moving assets physically and off the books was happening after May - my own opinion is that they are both guilty of misleading and deceptive conduct. There is an absolute standup operator and nice guy in our little country who got burnt by these a-holes / I feel for everyone that has lost out.

I spoke to the liquidators and asked if they pursue 'insolvent while trading' which goes beyond the company protections, and can bring the director to civil and in some cases, actual criminal charges. The representative indicated that they likely will on this one, it seemed from the chat, based on requests for payments in January, with such a long creditor list, and in some cases will send out an email for 'votes' whether they pursue it or not, but the order of things usually does the liquidation first.

In other words, this will likely continue for the directors personally, but it is not an overnight process.

Some more on those potential consequences are here - https://asic.gov.au/regulatory-resources/insolvency/insolvency-for-directors/#consequences-of-insolvent-trading

As I believe there exists strong support to see a penalty eventuate, I imagine there will be a push from the liquidators, or to ASIC directly from creditors, to see a satisfactory outcome, beyond us just bending over, and losing our collective shirts.

True .... don't think the liquidators realized initially the scale of this... and yes, if it goes to ASIC (noticed they need to notify them in the email), ASIC has VERY long arms

#9796 43 days ago

Fa*k, just saw the distributor figure $250k over the 3 distro’s.

What a clusterf*ck.

#9797 43 days ago

Wow.

How do those “always back an Aussie” quotes hold up?

Awful to see how many people will be left out of pocket by this fiasco.

If there were crimes committed by those in charge of Haggis Pinball, I truly hope they are held to account.

#9798 43 days ago

So looks like it really cost $20k a game to manufacture in Australia as 250 games made and 2.5 million in debt means a loss of $10k for each game manufactured.

Yeah wow, really? I genuinely think he went in with good intentions but had zero idea of how to cost such an undertaking, and then unfortunately rolled the dice trying to sell his way out of trouble rather than waiving the white flag early.

Were 250 actually produced? Will make that amount per game higher if 150 were made.
