So passed on buying LT from him got from Joe@pinballstar

Ok, I understand the non refundable deposit deal but in this situation they cant deliver what you ordered. Probably too much time has pasted but maybe check with your credit card if you paid that way. What a mess this all turned into. Very sad.

Agreed. Customers aren’t laying down deposits on absolutely nothing; they’re paying for an actual product. If that product ultimately can’t be delivered, then the deposit should be refunded. If not that, then at the very least, the deposit amount should be turned into store credit.

If we were to do a recap.
What is the Status as of today of Fathom remake?

Will Haggis deliver the remaining orders? Or did they fall victim to Covid 19 Fallout.

I almost pulled the trigger on this game and thought maybe I should wait until they are available from dealership.
Sadly pulled trigger on Ultraman instead.. While I got a game almost wish I hadn't.

I disagree. He took deposits on a game that now will never be delivered. He needs to step up and process the refunds.

So? That's business. Nothing to do with being a "bro". Distro's are 100% responsible if they took your money. It's then on them to chase Haggis. That's why you have a distributor. They can't have their cake and eat it to.

This is a poor business decision by Zach. He scored by buying a pinball business for a good price before the Covid price inflation blew prices up. If he doesn’t refund deposits this will be a stupid business move.

I won’t even buy a coil stop from him. His ego is too big IMO and his decision will cost more in the long run than refunding or moving the deposits to something else.

So he make less on a NIB sale. He will still make money. A real POS move that could be fixed and gain some respect and maybe some customers.

No more purchases until in stock. That’s what needs to be done.

Actually not correct.I really would like others here to declare their financial interest,ie deposit paid for a not received machine.For what it is worth I got my Fathom Mermaid,and declare a 3k interest in the Centaur Orblivion machine.

I'm not in this at all, but I would be looking at the person (or business) I sent money to as the party who owes me a game or a refund.
This is a mess and I feel bad for eveyrone involved.

Whilst the wait is absolutely ridiculous, and shit needs to happen fast to correct the wrong doing. How is any of this Zach's fault??

The reason people used him was for protection from this very thing. He's willing to lose his good reputation over a few thousand dollars? He talks about these expensive vacations he goes on on his podcast with, what assuredly, is about the same amount of money he should be refunding these poor souls that used him FOR THEIR PROTECTION. That's the whole reason they used him to buy the game and not going through Haggis directly.

And this isn't about being a "bro." This is about doing the right thing.

When you accept hard-earned money from a person you also accept the responsibility of solving the need/problem that they want you to solve, and if you can't solve it, you can always make a refund for the service or product that you couldn't cover.

This is called warranty, and if you don't take into account the cost of this it is your reputation.

From an outsider’s perspective looking at this thread and situation, it seems anyone trying to get their money from Haggis has given up hope of that and is moving on to their distributor. Understandably so.

Doubt anyone would advertise it, but I bet some got their refunds from their distributor already and quietly walked away. At least I hope so!

There is no product so anyone who is now holding onto deposit money would be commiting fraud. Not the distro's fault but thats the risk of being a distro. Because there is no product to be had you should check what your local trading laws say about this.

NONE OF THIS surprises me one bit with Zach. I wouldn't recommend him to anyone, after the shit he pulled with my JP30th fiasco...I just stumbled onto this thread this morning, and MY GOD, it just proves that Zorg's greed overpowers the faith of goodwill. I really feel bad for you guys that have deposits (or paid in full) with Fathom..what a shipwreck.

Zach is in a weird position. Being a distro and having a podcast "network" is a double edged sword.

I enjoy The Pinball Show, even though I recognize it as a very entertaining infomercial for Flip N Out. Like most podcasts, Zach talks about aspects of his life like recently buying a beautiful new home, constructing a huge warehouse sized barn for his inventory, going on expensive vacations, etc. We know more about Zachs' life than any other distro. He hosts a fun show, although I listen mostly for Dennis.

So when he then turns around and refuses to refund $1000 deposits on a game that has missed several deadlines from a company that is seeking to recapitalize and most likely will never produce the game (especially Centaur), it's just a bad look. IMO, he should issue refunds today and go after Haggis to recoup his money.

Here's hoping he reconsiders.

Not only that, but it would be bad for the industry overall if we start to be "ok" with distributors indefinitely holding deposits for games that are never built. I get distros send that money along to the company, but that's their risk. They don't get to push it onto the customer. And honestly, anyone doing business with this company should do everything in escrow. You simply can't believe them when they say something is "ready to ship"
