He chose not to inspect the machine prior to purchase. Sounds pretty straight forward to me.

Boy, it's too bad the people I've bought used cars from don't bother to point out every issue with the vehicle. It would have been nice for them to spoon feed me so I don't have perform due diligence when purchasing something used. It would have been wonderful if they would have pointed out every flaw with the vehicle so I could use it as ammunition in an attempt to drive down the price. /sarcasm
Did the seller intentionally misrepresented game? I have no idea without having access to all the correspondence. Was it the buyer's responsibility to inspect the game to his or her satisfaction prior to purchase? Absolutely. Would I have handled the transaction the same way? No, but everyone handles things differently.
