Totally depends on the state. Most require only one party (generally the person doing the recording) to consent, but Cali requires that everyone know about it, so you'll have to go on asking before you hit record. Looks like the case law is mixed, but if you're in NY recording someone in another state, NY law is likely to apply since that's where the recording took place.
