All you have to do is fill out the paperwork at the PO and the PMG will serve him a summons to appear in federal court to answer the charge of mail fraud.
Screw that convict, it would be worth the C note to let the feds run him through the machine.
He is counting on you to do nothing over 100 bucks that is how these criminals get away with this crap.

#52 10 years ago

Forget about small claims, just file for mail fraud.

#53 10 years ago

Please hold him accountable, we don't need people like this doing business, you would be doing everyone a favor.

#54 10 years ago

I do some ebay, 3 days is maximum I give myself to get something out once its paid for. 2 months is a crime. I think posting his info is going to cost him a lot of business especially if he has a lot of pins for sale. Plus I'm sure other pinsiders will like to text or call him just to harrass him or waste his time. You've been more than patient. I think its time for an ultimatum email. Advise you are posting to the hobby he is a scammer. Advise you are reporting him to postal inspector. Advise you are filing a claim.

#55 10 years ago

I'll litigate all over his a**! Lol.

I've posted to the GAPAS mailer; I'll let you know if anything comes of that.

So swampfire put me in touch with someone who lives near the seller and claims to have purchased something from him last night.

I'm pissed to learn that the guy is making time to sell to other people and hasn't shipped my PF. The seller is apparently ignoring my emails.

Thanks to everyone commenting and giving advice so far.

Thanks,
Jim

I hope you guys can work it out, I know that you want the playfield, not a refund. Big Game is a great pin! I added it to my WTB list after PAPA.

#60 10 years ago

You have a right to be frustrated. This guy got you for $100. Unfortunately, you just have to deal with it. Live and learn and remember this for the next time. You are thinking straight and taking him to small claims court or trying to get him for mail fraud is going to cause you a lot of aggravation. I assure you this isn't "Americas Greed" and the FBI isn't going to get involved....LOL....this is a small time criminal (very small time is sounds like) and unfortunately our legal system isn't going to be tremendously motivated to put this guy in the slammer.

We are all watching too many shows....LOL !!! It is $100 and unfortunately it happens all the time (people buy bogus tickets, items that are misrepresented, etc. etc).....just be happy he only got you for $100. You are aggravating yourself way too much in my opinion even though I WOULD BE UPSET as well.

I bought a T2 from a guy (my 3rd pin I ever bought). The guy was a SCUM*** in the 1st degree. I get the T2 and it is missing the Hunter ship and Skull....he sent me a fraudulent picture. I WAS PISSSED in a big way. My wife talked some sense into me and she was right. It was better to spend some money and just make the machine right and write it off then to get so upset. NONE OF US LIKE BEING TAKEN.....but I am sure we all have one way or another in our life.

Just thank your lucky stars it was only $100....watch a couple of episodes of Americas Greed and you will see people who got scammed and have REAL PROBLEMS.

However, your playfield isn't coming......if it was the guy would have called you or e-mailed you an apologized a million times.....he is ignoring you because he has no intention of sending it in my opinion so just write it off. GOOD LUCK and I hope I am wrong !!!

Could have went all night without seeing that......well their went the mood !!! LOL !!!

Quoted from swampfire:

It's not over yet.

There may be a glimmer of hope. The person swampfire put me in contact with verified that he has worked with the seller and recently bought something. He verified the address I sent the money order to, as well.

I left the seller a voicemail on the number he has on his Mr. Pinball listing and sent a follow-up email indicating that I want to send someone local to pick up the PF for me and hope that he's willing to work with me on that.

At the end of the day, I want the PF so I can finally play my Big Game, so I'm approaching it in a nice-guy, here's an easy way out method before devolving into legal threats and blacklistings.

Thanks to all for the help so far, and big thanks to swampfire!

I may just be naive, but the seller has really gone out of his way to relatively keep in touch through infrequent emails (though I haven't heard back from him since starting this thread). I have to think if he was just in it for the scam, then he would have denied ever receiving the money order. I didn't have tracking on it or anything.

Furthermore, I had contacted him long before agreeing to buy the Big Game PF about another PF that he sent me a lot of pictures for. After months, I asked about the other PF when inquiring about the Big Game one, and he told me he had sold it already. I would think if he was scamming, he'd offer the other PF I was interested in for another $100 which I would have jumped on in a heartbeat.

I really want to believe that the guy is inherently good, and maybe has fallen on some bad times. I'm not saying that's an excuse for not making good on the deal yet, but it allows me to hold out hope that I'll eventually get what I want.

Let's put a little bit of optimism out there!

Thanks,
Jim

Sorry dude....but you really need to find your backbone. What this seller has done is 100% inexcusable, and for you, as a buyer, to make plausible excuses for him is pathetic.

He is actively conducting business while ignoring you and your purchase which he has the money for. Scam, theft, stupidity, whatever, it's purely unacceptable and bordering on complete theft. Why would you condone such behavior? Keep having the faith....the Great Pumpkin will be here in 37 days.

Your hundred dollars is a thing of the past. I say go to the local casino and put another $100 on black and try to win it back. If that fails then do $200, $400, $800, $1,600.....your odds are excellent that you get it back that way (well over 90%). If that doesn't work well just think of the great story you will have to tell your friends for many years. Trust me, I have quite a few....LOL !!!

Good luck to you....second thought play RED....however, wait for 5 blacks in a row before you lay down the $100.....that always works for me.....LOL !!! Or is it play Black and wait for 6 Reds in a row.....let me check my notes and get back to you. Just make sure you have at least $3,100 to bet just in case you don't hit the first few spins !!!!

Thanks for the insult! That's super helpful! I decided not to take the bait and deleted my insult back to you.

I was merely stating that I'm staying positive at the moment in light of the recent contact I made with someone local to the seller, and I'm trying the high road approach before doing something else which will likely not result in me getting the PF.

If you play black and red you can't win but you can lose....if Green comes up (0 or 00) you lose half your bet. Trust me, that has happened to me. Not as bad as the one time at the Breeders Cup I had bet a SURE THING (LOL) exacta. My two horses were way ahead of the field and I had the Exacta boxed (so it didn't matter what order as long as my 2 horses finised 1st and 2nd). Well, about 100 feet from the finish line I had this thought "well, as long as one of my horses doesn't fall down I am a WINNER"....just as I was thinking that it was like SLOW MOTION and one of my horses went down (horse was called GO FOR WAND and it was running for horse of the year). Well to this day everyone with me that day still believes I killed that horse as it had to be destroyed. So my GOOD LUCK strikes again !!! LOL !!!!

As for the hundred going to the casino is your best bet to get it back quickly.....still my advice.

I learned about winning, I mean losing, at roulette my first time at a casino... nevermore!

The pinhead rules of engagement require me to tell you that yes, you have most likely been scammed. It does not take 2 months to ship a playfield. You can pursue him directly, but chances are equally good that he's eaten, drank or smoked your money already. You can go after him and pour more good money after bad or you can consider it tuition and never mail cash or cash equivalents in advance again. Both have their merits, but in your shoes I'd vote for door #2.

I think putting up a copy of the complete correspondence online where Google can get access to it would be fair and reasonable.

Just my $0.02..

Ha, lucky man! My first casino experience, I borrowed $20 from my dad, turned it into $80 and stopped. I did not do so well 10 years later when I played Blackjack over several days.

#74 10 years ago

You didn't read the HOP ways to win at roulette before you played (bought at any Barnes and Noble or Amazon.com for $1.99). Never fails....well almost never.....LOL. The one time it fails you lose a ton of money that more then offsets the $100 wins you have.....and if that fails you can always go to the Pass/Don't Pass line on Craps !!!!

How about door #3?... I'm not going to mail money orders anymore. Definitely learned that lesson. I'm not going to give the seller any more money, but I'm going to pursue getting my PF until I'm tired of doing so. Then I'll pursue legal action, blacklisting, and fraud claims until I get tired of that.

Wait a minute here. You come here on open forum, ask if you have been scammed, and then want to defend the seller that has your money but never sent your merchandise? Then you find out that the seller is still conducting business from/with other pinsiders and you want to have faith in the seller ? But you are upset that I told you to find your backbone? There is something completely wrong and backwards here. I am insulted that you continue to allow the seller to keep your money and your goods, and then we all have to wonder how people get away with such behavior. They get away with it because it is tolerated by buyers "hoping" that someday the light will shine down and miraculously their goods will show up at the door with a heartfelt apology that their dog died, the car broke down, or the monkey shit on the carpet.
Please, you are insulted. Good luck with that.

My game plan when I went was to make $5 bets and always bet on the same color, and double up the previous bet if I lost. If memory serves, I was up $300 at one point... then I was in the hole... went to the ATM a few times... left unhappy...

In case your reading comprehension is lacking, I never said the seller's actions were excusable. If you're able, you might read through what I said again and see that I in fact stated that in spite of what I had observed about the seller so far that he doesn't have an excuse for not making good on the deal.

In no way do I plan to let the seller get away with it. I'm merely trying one approach right now.

But you are trying to make an excuse for him. My comprehension is just fine.

Is your comprehension fine? I am not making an excuse for him, and you just quoted me saying "not saying that's an excuse..." I'm stating that based on my observations of his behavior, I have a hard time believing his ultimate goal is to scam. He's put way more work into it than would have been necessary. I also threw a bit of positivity into the universe with a hope that the guy is inherently good.

You're also indicating that I'm letting him get away with this, and that's not the plan.

Any constructive advice on how you'd handle a situation like this in order to not let the seller get away with it?

Look man, I am the last one to want to see anyone get scammed. I am pointing out that your "wait and hope" approach has gotten you nothing but 2 months of "where's my playfield?". Throw this seller to the dogs. Help other pinsiders out with the information on this guy so no one else gets burned. Take up the offers of fellow pinsiders to go knock on his door and get your playfield now. He is ignoring you with YOUR $100 in HIS pocket. You have lint, but still hold out hope. You are being taken advantage of here. I will say it again, man up and use the resources that fellow pinsiders have offered you to get your playfield. If your insulted by that, then I am sorry for you.

Man, you're making the theme of poor reading comprehension an easy one to keep going... I AM pursuing an option with a local person! They aren't at my command, however, so I can't simply say, "Go knock this guy's door down and get my PF!" I have to graciously accept their offer to help in a way they're comfortable offering.

And for now, how about play it safe and don't send money to anyone in Jefferson, GA?

#84 10 years ago

So now all people of Jefferson, GA are bad?

Hey, if you've got guys on here who are willing to go pick it up for you then problem solved. If he refuses to setup a time for them to pick it up, it's a scam. Then we'll excommunicate him from the pinball fold and he'll go to pin-hell where the balls are rusty and the machines poorly maintained...

On a serious note, good luck with it. I'm really impressed people here offered to go pick it up for you.

That's called the martingale and it's been a mantra of the suckers who keep casinos open for 300+ years. My surprise that you are championing this "strategy" is null.

But you've got a 100% chance of winning almost 50% of the time! You could make a pretty sweet living playing roulette! Maybe I'll head to the casino this weekend and make my $100 back and get enough to buy a nice HUO Big Game...

It's at least a little bit poetic that in a thread where people are trying to help you after having been scammed, this dude is trying to volunteer you for the martingale, one of the longest running scams in history.
