i don’t think there’s any chance of proving theft here. What you have is a case for Replevin. Too late for a law class but google it. Your county Courts Online may have a sample form. Better to retain a lawyer to do it right. Sometimes it is worth it to pay a little extra (like a credit card fee) or a lawyer. Good luck Rob

Unless the OP gives us some more details, I think that part of this thread is about dead.

I think 99% or more of us agree paypal sucks.

What I want to know now is just how many people have been sending emails to Vid to get him to come back?

I never would of thought of bugging someone enough to try to get them back.

    Quoted from Manimal:

Everyone needs to stop thinking of the "friends and family" part of PayPal as offering some sort of protection....THERE IS NONE.....Period. The only thing F&F does is to allow the sender to pay the percentage PayPal holds for facilitating the transaction. Outside of that, there is no difference in protections offered. The sender can still do a chargeback, they can still make a complaint, etc. End result, you can get just as screwed with F&F as with any other CC based payment.

I don’t know if it is still the case, but PayPal used to tell you that if you sent F&F that you had no protection, and they asked to please confirm that you are not purchasing an item because you will have no recourse. Considering they used to provide the statement (not sure if they still do now), it is providing false information, which is a dangerous interpretation from the sellers point of view. Don’t get me started on PayPal. They used to show fees and would refund fees on refunded transactions. Now they don’t refund fees, hide the amount you pay in fees when issuing a refund and tell you to “see there terms and conditions” in the line where they could just as easily show the money you are paying PayPal.

    Quoted from xamindar:

The proper name for that in the US is, Innocent until proven guilty.

Are the buyers who have both OP’s machine and a full refund of payment they gave him innocent?

Sorry but just like The Dewey Cox song these buyers are obviously
    “Guilty as charged “

You forgot the part about would have knocked any children out of the way.

That’s easily one of my favorite Pinside tales of all time!
    What were his buddy’s names?
    Popock and Beelow ?

Did OP finally admit it was a joke post to bust Vids balls ? I can’t remember.
Can someone please post a link to that topic, I can’t seem to locate it.

Maybe during his return Vid gave the contact info for these two gentlemen to the OP

My son's car got hit in the middle of the night in front of our house. We live in the back of a subdivision, only traffic is neighbors. You could clearly see where the cars fender had dragged down the middle of the street, around the corner and up into a driveway/garage. Went to police station, they wouldn't even knock on the door so I did. They insisted the young daughter, my suspect, hadn't been in an accident but refused to open the garage. Mom said "Let me go ask her", walked around a corner for literally 5 seconds, came back and said No, her car is fine.

That was 2 years ago - the scrape in the road and their driveway has now rusted/oxidized, and you can still see it plain as day.

Don't expect ANY help from the cops.

Pinside needs a daily briefing about the status of this situation!!

My father had a similar situation. Suspect arrested. As always, it depends on the town.

Mean Streets of Belleville, MI! I moved from there in 1976 anticipating stuff like this would happen eventually.

In all honesty, we haven't heard their side so how can you pass judgement on them so decisively? Whatever, I'm just glad I live in the US with these basic human rights.

    #262 3 years ago
    Quoted from TigerLaw:

If law enforcement is not willing to travel to you to receive the complaint and statement, the proper protocol is to go down to the precinct and file your complaint in person. Many insurance companies require you to do this for stolen items and law enforcement will accept your complaint (they may do nothing about it, but they will give you a complaint number and keep a record of it).

The police gave me a case number right away when I made the first call. That was all USAA needed.

I agree and feel fortunate to live in the USA but... if the buyer was refunded the full purchase amount by their CC company They should have contacted the seller to pick up the machine. Not doing that is criminal in my opinion as long as the OP didn’t twist any the facts.

There’s literally dozens of countries with the same basic human rights. Why does stupidity like this always creep into threads?

It’s amusing that it annoys you.

I'm surprised the pin hasn't popped up for sale online yet.

Well, if they moved to Michigan then maybe they did:

Although this looks like a total scam/hoax and not a real machine...

Canada and the UK for starters. Most of Western Europe. Australia. Japan.

The obvious point of divergence between you and Levi will be the 2nd Amendment, and whether you consider gun ownership to be a "basic human right" or not. If you set guns aside, there are a number of countries that have functional equivalents to our Bill of Rights (as amended). The truly unique thing about the US is we got ours first.

I saw one for sale in New Jersey on Ebay, but that seller looks like a regular.

    Quoted from majicman110:

    Genuine and sincere question.
To all of you who are saying "cash is king" don't you think that you are more likely to get ripped off showing up to a stranger's house with cash?
I tell you I have a machine available for $4k. Cash only. I give you some random address and show up with a gun. When you pull up I wait in the driveway, tell you to come in then pull s gun on you and walk away with $4k cash.
If you go through PayPal (not using friends and family) I would think you are much less likely to get ripped off. As a buyer, I would see it as a red flag if you didn't accept PayPal and expected me to show up with cash.

    Quoted from Fezmid:

You got downvoted more than I think you should have. I agree with you - carrying a lot of cash on hand makes me nervous. Hell, the one time I had $5k in cash for a machine, I was super nervous walking out of the BANK...

This actually happened in Albany, ForceFlow can confirm. Someone had a super sketchy ad and someone went out anyway and got robbed at gunpoint.

My recommendation is to split the money up with other people, or hide it in your car. Never carry it in until you check out the machine and verify everything.
I also never pickup alone. More protection with witnesses!

My recommendation is to try to buy from Pinside members if at all possible.

So far all my buying has been from a local distro, but when I sold games on here after I was tired of them, a couple pm's and phone calls and I was never concerned about any member here coming in my house, and the buyers were never concerned either because they always came alone(except for the last buyer that brought his wife along).

Cash on the glass and local pickup is king. Pinside is awesome with helping that to happen.
