Can you take your county to small claims court?

    Ive never filed a court case before. Maybe someone has some knowledge. My car was damaged at a county facility by a metal rod that a county worker left behind. I had the cops come make a police report, I took pictures filed a claim with county clerk and they denied it. I thought it was cut and dry but, they dont want to take responsibility. And it was for only $400. So now I guess I need to take county to small claims court? Who do I file against? Will they actually send someone to court? thanks for any info.

    I can't answer the first part, and it may even vary from state to state. But, if you sue someone and they don't show up, you win the judgement by default.

    I would next call my County Council Member, things like this is one reason why he/she was elected.

    Sound advice. You're more like to get quick resolution this way than by filing suit.

    I know most of the time it's the principle of the thing...but just keep in mind as you proceed.....TIME IS MONEY..............Joey
