    Is it actually named 2Up ?

    The reason I ask, is because I wonder if it is available.

    1Up, 2Up, 3Up, etc. were forerunners of the company that became 7Up, and they may have kept rights to predecessors.

    I wasn't kidding. I was serious if the place was actually using the name 2Up. And if it was available. 7Up may well own the rights to it and have the resources to protect it.

    There was a man who saved up, invented a soft drink and named it 1Up. Went broke. Saved up, borrowed, changed formula and started again with 2Up. Went broke and borrowed from friends and relatives and tried again once again changing formula and named it 3Up. He kept this up until 6Up, and after that soft drink too failed, he no longer could get money together and finally gave up.

    He sold formulas, company's assets, everything and the new owners started over. Changed the formula and renamed it 7Up. Which still exists today.

    It isn't different if you are infringing on trademarks, etc.

    A quick search shows there is a 2Up LLC.

    You couldn't open a place and call if Kodak, for example.

    I looked it up on the federal registry . . . I didn't see anything that would cause an arcade concern for using that name . . . there is a 2 up wine, a 2 up motorcycle club, and several different 2 up 2 down types of names that are recorded that wouldn't personally concern me if I was opening an arcade with a similar name . . . (I'm not giving anyone legal advice, just saying I personally wouldn't lose any sleep over the name if I was opening an arcade)

    I think he is safe as long as he doesn't use a similar design for the "2up." However, I would definitely look into it before you spend any money on a store sign and whatnot.

    Again, not giving anyone legal advice to which they may rely . . . but you can have multiple different operations or products use the same or similar name. Think about how many Tex-Mex restuarants go by the name Casa Ole; how about the Ford Taurus or the handgun Taurus (both companies use and protect the same name for totally different types of products where there is no chance of confusion).

    In the old Pete's monkey bar.....have a bunch of video games. Greart set up. Like an arcade with a bar attached. Morgan the bartender is a very amiable dude.

    That games are in great shape and I think the lineup speaks for itself.

    Cool. Ill be in both places Mon, Wed and Fridays.
    We're already getting a Magneto XMEN for the 2up.
